Instruct Staff to forward to the Parks and Recreation Commission and the Archaeological Advisory Committee for information. BACKGROUND: • Immaterial Amendment to Mitigation Plan Approved by Coastal Commission: On February 18, 2004 the Coastal Commission approved an "immaterial amendment" to the previously approved "Mitigation Plan for Significant Cultural Resource Discoveries — Hellman Ranch Specific Plan Area, Seal Beach, California ". The amendment will be effective ten working days after the action of the Commission if no written objections are received. The basic determination of the Coastal Commission will place the proposed "Educational Center" approximately 900 feet northerly of the rear property line of the existing homes fronting Crestview Avenue and approximately 160 feet north westerly of the proposed homes being developed by John Laing Homes. This location is generally in accord with the City- approved location from September 2003, and is actually further away from the existing Crestview homes and the Heron Pointe residential lots. As indicated previously to the City Council: ❑ the proposed education center location and all trails serving the facility that are not located with the dedication area of Gum Grove Park are to be maintained by the homeowner's association; ❑ the trail pathways will be required to comply with ADA accessibility requirements, and will probable be constructed of decomposed granite; and ❑ the proposed education center location and initial trail system can hopefully be incorporated into a larger trail sy for the eventual 100 -acre wetland restoration area in the future. RESERVATION OF LAND FOR WATER QUALITY PURPOSES A. The area of land containing the proposed water quality basin, bio- swale and riparian corridor, and associated appurtenances as depicted in Figure 8 (inclusive of the landscaped areas) of the Storm Water management & Water Quality Control Plan, (SWM &WQCP) prepared by MDS Consulting and Fuscoe Engineering of Irvine, California, dated July 27, 2000, shall be reserved for water quality improvement purposes through a deed restriction as required pursuant to subsection B. of this condition. The deed restriction shall not preclude use of the same such land for wetland restoration provided the water quality improvement functions of the system described in the SWM & WQCP, as revised and approved by the Executive Director pursuant to Special Condition 23, is, at a minimum maintained. In addition, the deed restriction shall not preclude construction and maintenance of the access road depicted on Figure 8, nor shall it preclude the construction and maintenance of the utilities and oil transmission lines depicted on Vesting Tentative Tracts 15381 and 15402, as approved by the Executive Director, nor shall it preclude the maintenance of existing oil operations, provided the water quality improvement functions of the system described in the SWM &WQCP, as revised and approved by the Executive Director pursuant to Special Condition 23, is, at minimum maintained. i.leitt-I-FyMThe deed restriction shall not preclude development associated with the archaeological investigation required pursuant to Special Condition 19. Finally, the deed restriction shall allow for the installation, operation, maintenance and use of public trails and an educational facility within the deed restricted area as described in the Mitigation Plan for Significant Cultural Resource Discoveries rerc uired pursuant to Special Condition 19,provided the water uality im rovement functions of the system described in the SWM &WQCP, as revised and approved by the Executive Director pursuant to Special Condition 23, is, at minimum maintained." Further, the amendment proposes to modify the Mitigation Plan for Significant Cultural Resources that has previously been approved by the City and the Coastal Commission as follows: Education Center Update CC Staff Report 2 Update Report — Education Center at Hellman Ranch City Council Staff Report February 23, 2004 ❑ Relocate the cultural educational facility from Gum Grove park to an area west of the Heron Pointe Pocket Park, within the grading limits as established by CDP 5 -97- 367 -Al; ❑ Revise the document to include provisions for additional public access to the educational center from Gum Grove park and through the development including from Heron Point Pocket Park by the addition of two new trail segments and connectors; ❑ Amend an existing deed restriction recorded pursuant to Special Condition 24 to allow the installation, operation, maintenance and use of a public trail and educational facility in the deed restricted area; and ❑ Add a new deed restriction to provide public access over and passive recreational use of the education center, a spur trail leading from Gum Grove Park to the cultural education center, a trail linking the Heron Pointe Pocket park to the spur trail, and a trail leading from Heron Pointe Drive to Heron Pointe Circle to secure public access to the re- located facility. The amended and new deed restrictions must be recorded prior to issuance of any coastal development permit authorizing construction of houses on Tract 15402, unless the spur trail and cultural education facility are fully constructed and open for use by the general public and the Executive Director waives this pre- condition for good cause. A copy of the approved "Education Center and Trails Location Plan" from the revised Mitigation Plan for Significant Cultural Resources is provided as Attachment 1, which indicates the approved location of the cultural education center and the additional public trails. Summary of Past City and Coastal Commission Action: On August 7, 2003 the California Coastal Commission considered and approved the "Mitigation Plan" for -the Heron Pointe development by John Laing Homes located on the Hellman Ranch property. The Coastal Commission approval included approval of the location of the "education facility" at a location previously reviewed and rejected by the City Council on July 28, 2003. On August 25, 2003 the City Council received and filed a Staff Report regarding the status of the education center and concurred with a public review schedule proposed by staff. The Parks and Recreation Commission considered this matter on September 10 and recommended approval of the request on a 3 -1 -1 vote of the Commission. The Commission recommended the "Option C" location to address the concerns of all persons, including neighbors that spoke at the Commission meeting. The Option "C" location was proposed to be located approximately 720 feet west of Seal Beach Boulevard, to the west of the most westerly homes to be constructed as part of the "Heron Pointe" development by John Laing Homes. The proposed location is approximately 745 feet to the north of the Crestview homes, behind 1717 Crestview. Notice of the City Council meeting was mailed to all property owners and to occupant of those residential properties along Crestview on September 2, 2003. FISCAL IMPACT: None. RECOMMENDATION: Receive and File Staff Report. Instruct Staff to forward to the Parks and Recreation Commission and the Archaeological Advisory Committee for information.
