Director of Public Works /City Engineer SUBJECT: ACCEPTANCE OF THE SEAL BEACH BOULEVARD AND WESTMINSTER AVENUE INTERSECTION WIDENING PROJECT NO. 49665 SUMMARY OF REQUESTS: The proposed action will formally accept the completion of the construction of the Seal Beach Boulevard and Westminster Avenue Intersection Widening Project No. 49665. BACKGROUND: This project widened the intersection of Seal Beach Blvd. and Westminster to include additional dual left turn lanes on east and westbound Westminster, dual left turn lanes for southbound Seal Beach Blvd., an additional through lane for eastbound Westminster, relocation of utility poles, traffic signal upgrades and realignment modifications improving traffic flow, capacity and safety at the intersection. The City competitively ' secured OCTA's Measure M, Intersection Improvement Projects and GMA #6, to improve the intersection capacity at Seal Beach Blvd. and Westminster Ave. On March 23, 2003, Council elected to award the project to Sequel Contractors, Inc. In accordance with the plans and specifications, the Contractor has completed the above referenced project. There were delays due to its subcontractor's delay in getting the signal poles and signal work. Staff negotiated with the contractor approximately $20,000 in additional paving, landscaping and signal work in exchange for the delays. The final contract amount is $742,084.37. FISCAL IMPACT: Funds in the amount of $1,002,000 are available from the Measure M Intersection Improvement Project monies and GMA #6 within the City's approved 5 -year Capital Improvement Program budget to construct these improvements under Project No. 49665 including design, utility relocation, construction and inspection. Agenda Item E RECOMMENDATION: Upon motion of the consent calendar, it is recommended that the City Council: 1. By resolution, determine the work has been completed in accordance with the contract documents and declare the work to be accepted and the total amount of the contract is in the sum of $742,084.37. 2. Direct the City Clerk, within ten (10) days from the date of acceptance, file a "Notice of Completion" with the Orange County Recorder. 3. Direct City staff, upon expiration of the thirty-five (35) days from the filing of the "Notice of Completion," to make the retention payment to Sequel Contractors, Inc, in the amount of $74,208.44.
