Bahorski, City Manager FROM: Lee Whittenberg, Director of Development Services SUBJECT: Adoption of Fees to Implement "Newsrack Ordinance" SUMMARY OF REQUEST: Adopt Resolution Number , A Resolution of the City Council of the City of Seal Beach Adding Section 5.E.25 to Resolution No. 5141, Establishing the Rates and Amounts of Fees and Charges to Implement the Provisions of Chapter 11B, Newsracks, of the Code of the City of Seal Beach. Please see Attachment 1 to review the proposed resolution. BACKGROUND: On January 12, 2004 the City Council adopted Ordinance No. 1510, establishing new location and design standards for newsracks located on public property by amending Chapter 11B of the Code of the City of Seal Beach. The new regulations regarding newsracks require the establishment of certain permit and impound fees to be established by the City Council. Staff has prepared a "Fee Cost Analysis - Newsrack Ordinance Provisions" dated January 26, 2004 to recover costs of reviewing requests for newsrack permits and issuing the necessary permits, and undertaking impound actions. The result of that analysis is provided as Attachment 2. The proposed fees to be established are as follows: ❑ Newsrack Permit Fee per Section 11 B.3(c) - Non -Lottery Locations - $ 71.00; ❑ Newsrack Permit Fee per Section 11B.3(c) - Lottery Locations - $ 110.00; ❑ Newsrack Summarily Impound Fee per Section 11B.10(a)- $ 120.00; ❑ Newsrack Non - Summarily Impound Fee per Section 11B.10(b) - $ 61.00; and ❑ Newsrack Non - Summarily Impound Fee after Required 10 -Day Grace Period to Correct per Section 11B.10(b) - $ 100.00. The fees established are set at a rate to offset the anticipated staff costs to conduct the activities that are subject to the proposed fee. The fees proposed do not exceed the anticipated staff costs to process the subject requests. RECOMMENDATION: Adopt Resolution Number , A Resolution of the City Council of the City of Seal Beach Adding Section 5.E.25 to Resolution No. 5141, Establishing the Rates and Amounts of Fees and Charges to Implement the Provisions of Chapter 11B, Newsracks, of the Code of the City of Seal Beach.
