Bahorski, City Manager FROM: Lee Whittenberg, Director of Development Services SUBJECT: RECEIVE AND FILE — STAFF COMMENT LETTER re: "DRAFT RECORD OF DECISION/REMEDIAL ACTION PLAN — OPERABLE UNIT 4, IR SITE 40, NAVAL WEAPONS STATION, SEAL BEACH SUMMARY OF REQUEST: Receive and file staff comment letter re: "Draft Record of Decision/Remedial Action Plan — Operable Unit 4, IR Site 40, Naval Weapons Station, Seal Beach ". Instruct Staff to forward to Environmental Quality Control Board for information purposes. BACKGROUND: The Navy has issued the "Draft Record of Decision/Remedial Action Plan — Operable Unit 4, IR Site 40, Naval Weapons Station, Seal Beach" ( "ROD /RAP "), and is requesting comments by January 12, 2004. Due to other staff responsibilities and the holiday meeting schedules, this draft document has not been reviewed by the Environmental Quality Control Board. This site includes an active locomotive repair shop (Building 240) and an unpaved (gravel) area located north of an adjacent to Building 240. The City of Seal Beach has reviewed and commented on many of the previous evaluation documents relative to IR Site 40, and has by previous communications to the Navy indicated its support of the proposed methodology of enhanced in situ bioremediation, monitored natural attenuation, and institutional controls to address the contaminated groundwater plume located at IR Site 40 as proposed in the Draft ROD/RAP. The Environmental Quality Control Board did review and comment on the "Proposed Plan/Draft Remedial Action Plan, IR Site 40, Naval Weapons Station, Seal Beach" on September 25, 2003. The subject ROD /RAP proposes to proceed with the treatment program that the Environmental Quality Control Board indicated support for in the September 25, 2003 comment letter and as evaluated in the Special Initial Study for In Situ Lactate Enhancement at Installation Restoration (IR) Site 40, Concrete Pit /Gravel Area, Naval Weapons Station (NANWPNSTA) Seal Beach, California ", prepared by the California Environmental Protection Agency, Department of Toxic Substances Control. Staff will continue to review all follow -up reports and provide additional updates to the City Council and the Environmental Quality Control board as appropriate. FISCAL IMPACT: None. All remedial actions to be completed at the subject site are the sole responsibility of the U. S. Navy. RECOMMENDATION: Receive and file staff comment letter re: "Draft Record of Decision/Remedial Action Plan — Operable Unit 4, IR Site 40, Naval Weapons Station, Seal Beach ". Due to the holiday - schedule and the requested response date of January 12, 2004, that was not possible in this - particular case. . The Final ROD /RAP will allow for initiation of the proposed project that is designed to cleanup groundwater due to the presence of volatile organic compounds (VOC), principally from the use of industrial solvents at the locomotive repair shop, that have been reported at concentrations that could result in adverse impacts to human health if the groundwater were extracted from the ground and used for domestic purposes. The City understands that the impacted groundwater at IR Site 40 does not serve as a source of water for any of the beneficial uses designated in the California Regional Water Quality Control Board's (RWQCB) Water Quality Control Plan, Santa Ana River Basin (Basin Plan), and therefore does not pose an immediate threat to human health or the environment. However, the human health risk for groundwater exceeds the National Oil and Hazardous Substances Contingency Plan (NCP) defined acceptable cancer risk and hazard index. The City of Seal Beach Environmental Quality Control Board ( "Board ") has previously • reviewed the report, from the Department of the Navy relative to "Proposed Plaii/Draft Remedial Action Plan, IR Site 40, Naval Weapons Station, Seal Beach." If you will recall, - the City commented on this matter on September 25, 2003, and a summary of the - , comments and responses to that comment letter are included in the "Responsiveness - . Summary" of the Draft ROD /RAP. At that time, the Board indicated it had previously recommended that the Navy pursue option 5B, which includes the chemical oxidation - - procedure. The September 25, 2003 Board letter further stated: Z \My Documents \NAVWPSTA\IR Site 40.Dratt ROD -RAP Stall Lettei doc \LW\01 -07 -04 City Comment Letter re: "Draft Record of Decision/Remedial Action Plan - Operable Unit 4, IR Site 40, Naval Weapons Station, Seal Beach" January 7, 2004 "Due to the overall cost of that alternative, and due to the results of the Pilot Testing, which has been done over the past 3 years, the City is now supportive of the Navy recommended alternative 5A. This alternative will allow for great remediation of the contaminants in an appropriate amount of time." On September 25, 2003 I also commented on the "Special Initial Study for In Situ Lactate Enhancement at Installation Restoration (IR) Site 40, Concrete Pit /Gravel Area, Naval Weapons Station (NANWPNSTA) Seal Beach, California ", prepared by the California Environmental Protection Agency, Department of Toxic Substances Control. Again, a summary of those comments and responses are provided in the "Responsiveness Summary" • of the Draft ROD/RAP. That comment letter indicated: "The City supports the proposed use of institutional controls, in the form of land -use restrictions. The proposed land -use restrictions are necessary to protect the integrity of the groundwater injection and monitoring wells and associated piping and equipment, and to prevent the use of the contaminated groundwater until Cleanup goals are achieved at IR Site 40." Those institutional controls are incorporated into the proposed ROD /RAP. The Draft ROD /Rap is in accordance with the formal positions taken by the City Council, Environmental Quality Control Board, and City Staff over the past 13 years regarding the assessment of potential impacts on human and ecological receptors at IR Site 40, the proposed methodology to remediate to existing contaminate levels and the chemicals of concern and implements the appropriate institutional controls necessary to assure long- term safety to humans and ecological receptors at the site. The Navy is to be congratulated for its responsiveness to the concerns of the City during the many years of evaluation and consideration of an appropriate action for remediation of this site. Those efforts are sincerely appreciated by the City Council, the Environmental Quality Board, city staff, and the citizens of Seal Beach. City staff has reviewed the above referenced document and has a minor correction that should be made in the final document on page 6 -1. The third paragraph of Section 6.1, Land Uses, indicates that Sunset Aquatic Park is located ". . . in an unincorporated portion of Orange County." That statement is incorrect; Sunset Aquatic Park is located within the corporate boundaries of the City of Seal Beach. Please correct the Final ROD /RAP to reflect this correction.
