Subject: Council Member Doane is requesting that the City Council remove from
the table the consideration of restructuring committee membership for the
Department of Water and Power Specific Plan Advisory Committee and to
take action on the staff report presented at the September 22, 2003
meeting
SUMMARY OF REQUEST:
Council Member Doane is requesting the City Council to remove the existing motion to
table the discussion on the restructuring of the DWP Specific Plan Advisory Committee
and to take action on the staff report presented at the September 22, 2003 meeting.
BACKGROUND:
At City Council Member Doane's request, this item has been placed on the agenda for
City Council consideration and action. On September 22, 2003 a staff report was
presented to the City Council outlining the several issues surrounding the DWP Specific
Plan Committee. Those issues were: does the committee need to be restructured? And if
so, possible alternatives to restructure the committee were presented to the City Council.
The City Council was also requested to confirm the current appointments or make new
appointments if necessary. (Attachment A)
This agenda item was tabled by the City Council on a 3 -2 vote. The City Council minutes
reflect that the agenda item was tabled until such time as a completed application is
submitted and until someone provides evidence as to why the committee should be
reconvened inasmuch as the application is not complete. Staff has attached the September
22, 2003 City Council minutes concerning this agenda item. (Attachment B)
Procedurally, the first action concerning this agenda item is for a Council Member to
make a motion to remove from the table, the action the City Council took on September
22, 2003. The motion to remove from the table will need to be seconded by a Council
Member and a vote taken. This first action is not debatable, meaning a motion, second
and vote is all that can take place. Of course this does not mean the public can be

prohibited from speaking on this issue during public comments. If the motion to remove
from the table fails to receive a second or a majority of votes, the action the City Council
took on September 22, 2003 stands.
If the motion to remove from the table is successful, then the City Council can debate the
issue of whether or not to consider restructuring the DWP Specific Plan Advisory
Committee or whatever other action it wishes, so long as it is relevant to the agenda item.
The staff report of September 22, 2003 provides the City Council with the options
concerning the DWP committee. Following the City Council discussion, a motion,
second and vote is still required to address the possible restructuring of the DWP
committee. In addition, the City Council still has the opportunity to make a motion to
table this item again or take another action regarding this agenda item that the City
Council deems appropriate.
FISCAL IMPACT:
None.
RECOMMENDATION:
Council Member Doane has requested this item be placed on the agenda. If the first
motion is successful, then the City Council will need to determine a course of action
concerning the DWP Committee.

SUMMARY OF REQUEST:
Consider the restructuring of the Department of Water and Power Specific Plan Advisory
Committee. Confirmation of City Council appointments.
BACKGROUND:
Submission of Application for Development Entitlements — Department of Water
and Power Property ( "Ocean Place "):
An application was filed on August 20, 2003 by Bay City Partners LLC, for development on
the DWP property, referred to by the application as "Ocean Place ". The application is for the
following matters:
• General Plan Land Use Amendment;
• General Plan Open Space/Conservation /Recreation Element Amendment;
o Zone Change from Specific Plan Regulation to Medium Density Residential;
• Repeal of the DWP Specific Plan;
o Tentative Tract Map for a proposed 39 lot subdivision; and
o Development Agreement.
Staff has 30 days to review the application materials and determine if the application as filed is
complete. If it is not (a preliminary review indicates that all of the required submissions have
not been submitted) the City will prepare a letter indicating the necessary items to be
submitted for the application to be deemed complete. That information will be provided to the
project proponent for preparation of the additional required materials, and upon submission of
the appropriate items, an additional 30-day review period will be initiated. This process will
continue until the application is deemed complete.

During this 30 -day time period, staff will also be reviewing the provisions of CEQA, the DWP
Specific Plan, the Riverfront Redevelopment Plan, the General Plan, and the Zoning
Ordinance to determine the necessary steps for the review and consideration of this project. A
detailed analysis of the various advisory committees (DWP Advisory Committee, Project
Area Committee, and Archaeological Advisory Committee), EQCB, Planning Commission,
and City Council reviews will be formulated during the 30-day review period and presented to
the project applicants and the affected committees, boards, commissions and the City Council.
Overview of Advisor Committee Status:
As part of this application review process, it is apparent that the membership of the
Department of Water and Power Specific Plan Advisory Committee needs to be
restructured, as the two organizations that have members on the Committee, the San
Gabriel Parks Society and the Old Town Business Association, no longer exist. In
addition, the current member representing the San Gabriel Parks Society is now a
member of the Planning Commission, and has a conflict as he will be making
recommendations on the project applications, and cannot serve on the Committee
The Department of Water and Power Specific Plan Advisory Committee was established
in conformance with provisions of the Department of Water and Power Specific Plan,
initially adopted by the adoption of City Council Resolution No. 3228 on November 22,
1982. The adopted Specific Plan states in Section 4.i:
"4.i. A nine (9) member Advisory Committee shall be established to
provide citizen input and review of all matters relating to this
Specific Plan."
On January 10, 1983, the City Council adopted Resolution No. 3236, which amended
Section 4.i. of the Department of Water and Power Specific Plan to read:
"4.i. That a seven mernber Advisory Committee shall be established to
provide citizen input and review of the Specific Plan."
The City Council also adopted Resolution No. 3234 on January 10, 1983, which created a
seven member "Department of Water and Power Specific Plan Advisory Committee ",
consisting of the following membership:
o Five (5) members selected by the City Council from the respective districts;
o One (1) member of the San Gabriel Parks Society;
o One (1) member selected by the Old Town Business Association.
The current membership of the Committee is:
o Linda Devine District 1
o Allen Harding District 2
o Rita Strickroth District 3

In discussions with Gordon Shanks, the current representative of the San Gabriel Parks
Society, he has indicated that the organization no longer exists. As Mr. Shanks is now a
member of the Planning Commission, he has a conflict, and cannot serve on the
Committee.
The Old Town Business Association is also non - existent, as it has merged with the Seal
Beach Chamber of Commerce.
Alternatives for Restructuring Committee membership:
Staff has two alternatives for the City Council to consider regarding the restructuring of
the Department of Water and Power Specific Plan Advisory Committee. They are
presented below.
Alternative 1: Maintain 7 Member Committee
Under this alternative staff would suggest changing the organizational
members to the Seal Beach Chamber of Commerce and the Riverbeach
Homeowner's Association. The Riverbeach condominium project is directly
across Marina Drive from the proposed project location. Staff would
recommend that only one resident of the Riverbeach development be
appointed to the Committee.
A current member of the Committee, Rita Strickroth, is a resident of
Riverbeach and could be appointed to serve, or the City Council could request
the Homeowner's Association to make an appointment to the Committee. In
discussing this matter with Mrs. Strickroth she has indicated that the
Riverbeach Homeowners Association Board of Directors has previously
confirmed her representation on the Advisory Committee.
Staff would also recommend that the Seal Beach Chamber of Commerce be
requested to make an appointment to the Committee.
The Riverbeach Homeowner's Association and the Seal Beach Chamber of
Commerce should provide written notice of the selection of said
representative to the City Clerk
0 Alternative 2: Restructure Committee to a Five Member Committee
Under this alternative staff would suggest changing the organizational
members to only include the City Council district representatives.

The City Council will need to adopt a resolution amending the make -up of the
Committee, as the existing Committee make -up was established by City Council
Resolution No. 3234. Staff has prepared a draft resolution for City Council
consideration. Please refer to Attachment 1 to review the proposed Resolution. Please
note that the resolution has alternate sections regarding the size of the Committee. The
City Council determination on this issue will result in the adoption of the resolution with
the appropriate Committee make -up.
This Committee has not held a meeting for several years, and the City Council may wish
to confirm their current appointments or make new appointments this evening.
Overview of Anticipated Public Review Process to Consider Project Applications:
As indicated above, the application is for the following matters:
❑ General Plan Land Use Amendment;
❑ General Plan Open Space/Conservation/Recreation Element Amendment;
o Zone Change from Specific Plan Regulation to Medium Density Residential;
o Repeal of the DWP Specific Plan;
❑ Tentative Tract Map for a proposed 39 Iot subdivision; and
❑ Development Agreement.
These requests are all discretionary applications before the City, and must be reviewed
and considered in accordance with the provisions of the California Environmental
Quality Act (CEQA) and the planning law requirements of the State of California. Staff
has prepared an "Anticipated Public Review Process — Ocean Place Development"
timeline that is provided as Attachment 3 for the information of the City Council. The
indicated timeline is based on reasoned assumptions as to the time periods involved in
preparing the necessary environmental review document, staff reports, and other project
related documentation. At this point, the time schedule does not factor in time
allowances for any public neighborhood meetings or study sessions before the Planning
Commission or City Council.
FISCAL IMPACT:
Minimal. Staff support costs would be reduced somewhat if the Committee membership
is reduced from 7 to 5' members. The primary reduction in costs would be for the
provision of agenda materials relating to meetings of the Committee.
RECOMMENDATION:
Consider the restructuring of the Department of Water and Power Specific Plan Advisory
Committee. Adopt Resolution No. , A Resolution of the City Council of the City of
Seal Beach Restructuring the Membership of the Department of Water and Power
Specific Plan Advisory Committee.

The City Council of the City of Seal Beach met in regular
session at 7:00 p.m. with Mayor Campbell calling the
meeting.to order with the Salute to the Flag.

Present: Mayor Campbell
Councilmembers Antos, Doane, Larson, Yost

APPROVAL OF AGENDA
Councilman Doane requested Item "P" removed from the
Consent Calendar for separate consideration, and Councilman
Antos requested Item "N" removed for the purpose of his
abstention from voting on the item.
Councilman Yost moved to table - Item "X ", the proposed
resolution to restructure the Department of Water and Power
Advisory Committee. Councilman Larson seconded the motion.
Councilman Antos inquired as to the time frame to table
that matter. The response of Councilman Yost was at least
until a completed application is submitted and until
someone provides some evidence as to why the Committee
should be reconvened inasmuch as the application is not
complete at this point, his understanding is that the DWP
property was purchased and the owners now want to change
the use of that property, yet a legislative decision was
previously made as to what was proposed for the property
which is well known. - Councilman Antos clarified that this
item is consideration of restructuring the membership of
the Department of Water and Power Advisory Committee.

Larson moved, second by Doane, to approve the order of the
agenda as revised.
