Ingram, Acting City Manager FROM: Mark Persico, AICP, Director of Development Services SUBJECT: ALLOW FIREWORKS ON PROPERTY LOCATED IN THE RECREATIONAL/GOLF ZONE (RG -ZONE) SUMMARY OF REQUEST: Introduce Ordinance No. 1606 to allow the public display of fireworks in the Recreational /Golf Zone subject to a Special Event Permit approved by the City Council. BACKGROUND: Per the direction of the City Council, attached is a draft ordinance that, if adopted, would allow the public display of fireworks on property located in the Recreational /Golf Zone (RG Zone) if the property is at least 25 acres in size and the person conducting the display first obtains approval of a Special Event Permit from the City Council in accordance with Chapter 7.50 of the Municipal Code. In addition to any and all other requirements of Chapter 7.50, a Special Event Permit for the public display of fireworks shall require the applicant to (a) satisfy all Orange County Fire Authority and Seal Beach Police Department requirements; and (b) abide by and conform to any and all applicable safety, professional, or technical standards and all applicable federal, State, and local laws regarding fireworks. FINANCIAL IMPACT: There are no direct costs associated with adoption of the Ordinance; however, there may be costs in the future if City staff becomes involved with traffic and /or crowd control. ANALYSIS: There are two parcels in town zoned Recreational Golf (RG): the golf course inside Leisure World and Old Ranch Country Club. This Ordinance was narrowly Agenda Item E crafted due to the potential public safety issues. If approved, it would apply to the Old Ranch Country Club (ORCC). On February 17, 2011, staff from the City Manager's Office, Development Services, Marine Safety, Police Department, Community Services, and the Orange County Fire Authority (OCFA) met to review the concerns of all the stakeholders. The group recognized that ORCC is very unique in size and location, and that the Facility could accommodate a fireworks show with minimal public safety impacts to the rest of the community. Based upon that uniqueness, the group generally supported annual fireworks displays at ORCC. But there was a concern voiced by the group that other facilities or interest groups would request special consideration for fireworks displays. RECOMMENDATION: That the City Council introduce Ordinance Number 1606 to allow fireworks displays in the Recreational /Golf (RG) zone on parcels larger than 25 acres subject to City Council approval of a Special Event Permit. Ordinance No. 1606 Agenda Item E ATTACHMENT "A" ORDINANCE NO. 1606 AN ORDINANCE OF THE CITY OF SEAL BEACH REQUIRING A SPECIAL EVENT PERMIT FOR THE DISPLAY OF FIREWORKS AT LARGE SITES ZONED RECREATIONAL /GOLF (RG ZONE) ORDINANCE NUMBER 1606 AN ORDINANCE OF THE CITY OF SEAL BEACH REQUIRING A SPECIAL EVENT PERMIT FOR THE DISPLAY OF FIREWORKS AT LARGE SITES ZONED RECREATIONAL/GOLF (RG ZONE) THE CITY COUNCIL OF THE CITY OF SEAL BEACH ORDAINS AS FOLLOWS: SECTION 1. Section 7.20.065 of the Seal Beach Municipal Code is hereby amended to read as follows: "A. It is illegal to sell, possess, or discharge fireworks, except pursuant to a special event permit permitting public display of fireworks issued in accordance with this Section. For purposes of this Section, the terms "firework" and "public display of fireworks" have the meanings set forth in the Califomia Health and Safety Code. B. The public display of fireworks is allowed on property located in the Recreational /Golf Zone (RG Zone) if the property is at least 25 acres in size and the person conducting the display first obtains approval of a special event permit from the City Council in accordance with Chapter 7.50 of the Municipal Code. In addition to any and all other requirements of Chapter 7.50, a special event permit for the public display of fireworks shall require the applicant to (a) satisfy all Orange County Fire Authority and Seal Beach Police Department requirements; and (b) abide by and conform to any and all applicable safety, professional, or technical standards and all applicable federal, State and local laws regarding fireworks. C. The fire chief shall seize, impound, and dispose of all fireworks sold, possessed, or discharged in violation of this Section. Any person who violates this Section shall be liable to the city for the actual costs of seizure, impoundment, and disposal of such fireworks, in addition to any and all other penalties available under the Municipal Code." SECTION 2. The City Clerk shall certify to the adoption of this ordinance. PASSED, APPROVED AND ADOPTED by the City Council of the City of Seal Beach at a regular meeting held on the day of , 2011.
