HomeMy WebLinkAboutAGMT - American Red Cross • American Red Cross Orange County Chapter Statement of Understanding This agreement is made and entered into between the City of Seal Beach and the American Red Cross Orange County Chapter hereinafter referred to as Red Cross. RECITALS The following agreement, along with its supporting addendum, provides the framework for a collaborative effort between the Red Cross and the City of Seal Beach to provide emergency support for disaster displaced members of our community. The parties hereto desire to reach an understanding that will result in making certain facilities and equipment from the City of Seal Beach available to the Red Cross for the aforesaid use. Now, therefore, it is mutually agreed between parties as follows: 1. The City of Seal Beach agrees that, after meeting its emergency responsibilities to its staff, it will permit, to the extent of its ability and upon request by Red Cross, use of predesignated facilities identified in Addendum #1, as temporary mass care sites to victims of disasters or service delivery sites to provide support for the victims of disasters. 2. Red Cross and the City of Seal Beach agree to provide, and periodically update the facilities and point of contact information with each other. 3. The Red Cross agrees, when normal communications methods are possible, to follow the notification procedures outlined in Addendum #2, when it needs to establish a Red Cross mass care or service delivery site at the listed facilities. 4. The City of Seal Beach agrees that prior to releasing facilities for use by Red Cross it will, to the extent reasonably feasible, evaluate the facilities and secure any valuable property not required for its normal operations. 5. Red Cross agrees that it will exercise reasonable care in the conduct of its activities in such facilities and when provided with documented inventory and cost information, further agrees to replace or reimburse the City of Seal Beach for any supplies used during the support operation. Page 1 of 9 < T • • 6. Upon termination of its use of the facilities, the Red Cross agrees to leave the premises in their original condition. 7. Red Cross agrees to provide training to the appropriate members of the City of Seal Beach staff in mass care and shelter operations. 8. The City of Seal Beach agrees that when their personnel are used in conjunction with the American Red Cross personnel, the Red Cross policies, regulations and procedures will be used to operate the site. 9. Use of the City of Seal Beach personnel, as Red Cross volunteers will be based on a mutual agreement between the individual, Red Cross and the City of Seal Beach. 10. Should any of the City of Seal Beach's facilities be used for food preparation or as a cafeteria, the City of Seal Beach's appointed representative shall be present to assist in the supervision and the use of the equipment, food and supplies by the Red Cross. The Red Cross agrees to replace or reimburse the City of Seal Beach at its option for any foods or supplies belonging to City of Seal Beach that may be used by Red Cross. 11. Should Red Cross request that staff of the City of Seal Beach be officially assigned to the operation, any agreement for financial reimbursement must be reached between the Red Cross Job Director and the City of Seal Beach within 48 hours of the request. 12. A designee of Red Cross and the City of Seal Beach will meet periodically to evaluate the necessity for the continuation of operations and to resolve any other operational concerns. 13. Should the City of Seal Beach request that the operation be relocated, before the end of the Red Cross requirements for operations, Red Cross agrees to relocate the facility within 48 hours of the Red Cross and local government locating a suitable alternate site. It is understood that it is a local government responsibility to facilitate the transportation of victims when shelter relocation is required. 14. Notwithstanding any other agreements, the American Red Cross agrees to defend, hold harmless, and indemnify the City of Seal Beach against any legal liability in respect to bodily injury, death, and property damage arising from the negligence of the said chapter during its use of any property belonging to the said City of Seal Beach. 15. Notwithstanding any other agreements, City of Seal Beach agrees to defend, hold harmless, and indemnify the American Red Cross against any legal liability in respect to bodily injury, death and property damage arising from the negligence of the said entity during its use of any property belonging to the Red Cross. Either party may discontinue this agreement in writing at anytime unless the facilities listed in Addendum #1 are currently being used as a shelter. 17. This agreement will be renegotiated in not longer than 5 years. June Yotsuya Parks and Red Department 562 431 -2527 562 799 -4100 Page 5 of 9 • • ADDENDUM #3: City Responsibilities & Red Cross Responsibilities City: As a general -law city, the City has responsibility for the maintenance of public health, welfare and safety within its geographic boundaries and for the preservation of life and property of its residents in the event of a man-made or natural disaster, through specific preparedness activities and by conducting and coordinating actual disaster relief operations, including the maintenance or restoration of normal government services and facilities. Consistent with municipal ordinances and the City's Emergency Plan, the City shall be responsible for the following: 1. Extension and augmentation of certain government services, including police and fire protection, warning and evacuation, search and rescue, emergency medical, public health and sanitation services; 2. Provision of communications, transportation and manpower to extend or augment normal government services; 3. Survey and damage assessment, designation of hazardous areas and structures, removal of debris from public property, and restoration of utilities and services; 4. Coordination of the care for the general public including the aged and infirm and those persons injured, disabled or displaced as a result of man-made or natural disasters; 5. Coordination with county agencies in the identification and disposition of deceased persons; and 6. Determination and coordination of priorities in the allocation and use of available local resources, and channeling requests for support through other public or private agencies. Red Cross: By Charter of the United States Congress, the Red Cross has the responsibility for undertaking relief activities for the purpose of mitigating suffering of "disaster victims" caused by man-made or natural disasters. This is accomplished by: 1. Providing emergency mass care including care and reception centers and shelters to any number of persons affected by disasters or in response to threats; 2. Handling disaster welfare inquiries from relatives outside the disaster area; 3. Providing emergency assistance to individuals and families on the basis of need, facilitating their ability to resume living in customary dwellings rather than in shelters; 4. Providing emergency and preventive health services, including psycho - social support to disaster victims and workers; 5. Providing referrals to families regarding other available governmental and private assistance and, if necessary, assisting them in making application for such aid; 6. Channeling assistance through normal commercial establishments in the City to aid in restoring disrupted local economies. Page 6 of 9 • • All disaster assistance provided by the Red Cross to disaster victims shall be an outright grant with no repayment required or requested. Methods of Cooperation and Coordination The City and the Red Cross mutually agree to cooperate in the development, implementation and coordination of their respective disaster preparedness, operations and training plans. This will be as follows: Disaster Preparedness 1. The City and the Red Cross will exchange disaster plan information and revisions through the Orange County Emergency Management Organization (OCEMO) to encourage uniformity. 2. The Red Cross and the City mutually agree to share their respective written disaster plans. Operations Liaison 1. During an actual disaster, the City will provide space within its Emergency Operations Center for a Red Cross Liaison. 2. The Red Cross will assign (as resources allow) a liaison to the City's Emergency Operations Center to assist in coordinating disaster relief operations during an actual disaster. Emergency Mass Care 1. The City and the Red Cross agree to cooperatively conduct and maintain an inventory of all buildings which could potentially serve as mass care facilities. As the need arises, the City and Red Cross will cooperatively designate one or more of these facilities based on projected need. 2. The City will advise the Red Cross immediately when the possibility of a shelter is indicated. 3. The Red Cross will retain administrative authority and financial responsibility for the mass care activities which it provides. A Red Cross shelter manager will be assigned to each mass care facility and will be responsible for managing the shelter, including assuming responsibility for the costs involved in providing Red Cross shelter and feeding operations. 4. The City agrees to admit properly identified Red Cross personnel into disaster areas to provide mass care services, such as feeding of emergency workers and disaster victims. 5. The Red Cross agrees to train City staff and volunteers as Red Cross volunteers. Training will consist of those courses outlined below. Upon completion of said training and approval of the Red Cross, individuals will be able to open a care and reception center or shelter in the name of the Red Cross. City staff opening these facilities must complete at a minimum the following training which will be provided at no cost by the Red Cross: Volunteer Orientation 0.5 Hrs. Introduction to Disaster Services, ARC 3066 2.5 Hrs. Mass Care: An Overview, ARC 3068 3.0 Hrs. Shelter Operations, ARC 3068 -11 3.0 Hrs. Shelter Simulation, ARC 3068 -12 3.0 Hrs. 12.0 Hrs. Advanced Training to become a qualified shelter manager is available through Red Cross; actual shelter experience is also required to qualify. Damage Assessment Operations 1. The City and the Red Cross mutually agree to exchange and share damage assessment information and to conduct assessments cooperatively to the maximum extent possible. 2. The City agrees to admit Red Cross Personnel into disaster areas to render assistance and conduct disaster damage assessments. Direct Assistance to Families 1. The City agrees to assist the Red Cross in establishing facilities as disaster service centers by providing use of City -owned facilities as available and requested. 2. The Red Cross will provide emergency assistance to disaster victims. In carrying out any relief activities, the Red Cross will exercise administrative and financial authority over its own operations. Disaster Health Services 1. The Red Cross agrees to train health care professionals to supplement its current roster of DHS personnel. Sources of DHS Staff include physicians, registered nurse, licensed practical or vocational nurses, emergency medical technicians or paramedics, physician assistants and some allied health workers. 2. The Red Cross agrees to provide Disaster Health Services support at Red Cross shelters. 3. The City and Red Cross agree to collaborate and exchange information regarding health services issues and concerns. Page 8 of 9 . _ ,. • 9 Recurrent Local Disasters The City will notify the Red Cross of family disasters (such as house fires) when families or individuals require immediate assistance. The Red Cross shall use its best efforts to dispatch a Disaster Action Team to meet the emergency needs of victims. Page 9 of 9
