ROLL CALL Present: Mayor Laszlo Councilmen Gray, Kredell, Seitz, Weir I Absent: None Also present: Mr. Courtemarche, City Manager Mr. Coughlan, City Attorney Mr. Johnson, City Engineer Mr. Biery, Assistant City Engineer Mr. Romaniello, Planning Director Mr. Jefferson, Engineering Aide Mr. Kosmont, Assistant City Manager Ms. Shelton, Administrative Assistant By order of the Chair with consent of the Council the meeting recessed at 7:12 p.m. until adjournment of the Redevelopment Agency meeting. Mayor Laszlo called the City Council meeting to order at 8:37 p.m. and with consent of the Council declared a five minute recess. The meeting reconvened at 8:48 p.m. with the Mayor calling the meeting to order. WAIVER OF FULL READING I Weir moved, second by Kredell, to waive the reading irrcfull of all ordinances and resolutions, and that consent to the waiver of reading shall be deemed to be given by all Council members after reading of the title unless specific request is made at that time for the reading of such ordinance or resolution. AYES: Gray, Kredell, Laszlo, Seitz, Weir NOES: None Motion carried PROCLAMATION Mayor Laszlo proclaimed the week of April 15 through April 21, 1979 as "National Coin Week". PUBLIC HEARING - AMENDING ZONING ORDINANCE - 60-DAY STATUTE OF LIMITATIONS to the zoning ordinance establishing a sixty day statute of limitations I Mayor Laszlo declared the public hearing open to consider an amendment for attacking zoning decisions. The City Clerk certified that notices had been published as required by law and that no communications had been received either for or against the matter. Mr. Romaniello, Planning Director, presented the staff report and recommendations of the Planning 4-9-79 3~r:;: ~~..f~ .I.' ,I Commission. There were no communications for or against the matter from the audience; Mayor Laszlo declared the public hearing closed. Kredell moved, second by Gray, to approve the Negative Declaration for the proposed amendment establishing a sixty day statute of limitations for attacking zoning decisions. I AYES: Gray, Kredell, Laszlo, Seitz, Weir NOES: None Motion carried ORDINANCE NUMBER 1061 - AMENDING ZONING ORDINANCE - 60-DAY STATUTE OF LIMITATIONS Ordinance Number 1061 was presented to Council for first reading entitled "AN ORDINANCE OF THE CITY OF SEAL BEACH IMPOSING A STATUTE OF LIMITATIONS FOR ACTIONS ATTACKING ZONING DECISIONS." By unanimous consent full reading of Ordinance Number 1061 was waived. Kredell moved, second by Gray, to approve the introduction of Ordinance Number 1061 and that it be passed to second reading. AYES: Gray, Kredell, Laszlo, Seitz, Weir NOES: None Motion carried I PUBLIC HEARING - AMENDING ZONING ORDINANCE - LANDSCAPING REQUIREMENTS IN NON-RESIDENTIAL ZONES and PARKING FACILITIES Mayor Laszlo declared the public hearing open to consider an amendment to the zoning ordinance establishing a 10% landscaping requirement in all non-residential zones plus one tree for each five parking stalls equally distributed throughout all public and private parking facilities. The City ~lerk certified that notices had been published as required by law and that no communications had been received either for or against the matter. Mr. Romaniello, Planning Director, presented the staff . report and recommendations of the Planning Commission. There were no communications for or against the matter from the audience. Mayor Laszlo declared the public hearing closed. The City Attorney informed the Council a copy of an amended ordinance had been provided to them correcting certain procedural wording. Councilman Gray referred to I the strict wording of the proposed ordinance and suggested those sections be amended to read 'trees......be fairly distributed' rather than 'equally'. Gray moved, second by Weir, to approve the Negative Declaration for the proposed amendment establishing landscape requirements in non- residential zones and parking facilities. ~g6~;9- 79 AYES: Gray, Kredell, Laszlo, Seitz, Weir NOES: None Motion carried ORDINANCE NUMBER 1063 - AMENDING ZONING ORDINANCE - LANDSCAPING REQUIREMENTS IN NON-RESIDENTIAL ZONES and PARKING FACILITIES Ordinance Number 1063 was presented to Council for first reading entitled "AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING THE ZONING ORDINANCE, CHAPTER 28 OF THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA." I By unanimous consent, full reading of Ordinance Number 1063 was waived. Gray moved, second by Weir, to approve the introduction of Ordinance Number 1063 as amended and that it be passed to second reading. AYES: Gray, Kredell, Laszlo, Seitz, Weir NOES: None Motion carried APPOINTMENT - ORANGE COUNTY HEALTH PLANNING COUNCIL Weir moved, second by Kresell, to appoint Ms. Margaret H. Beum, l42l-H Golden Rain Road, as this city's representative to the Orange County Health Planning Council Assembly of Delegates. AYES: Gray, Kredell, Laszlo, Seitz, Weir NOES: None Motion carried REPORT - OLD POLICE DEPARTMENT BUILDING I Mr. Johnson, City Engineer, presented an indepth report regarding the condition of the old police department building and referred to previous engineering studies regarding its structural stability. Mr. Johnson estimated todays cost for structural strengthing of the building would be approximately $450,000. Mr. Johnson noted ideas that have been suggested for the possible use of the building. Councilman Weir stated that after discussion with Supervisor Wieder he was withdrawing his suggestion to utilize the building for County branch offices. Councilman Gray stated a citizen had suggested possible grants and citizen donations for restoration of the building for public organization use. Mr. Gray suggested the building be demolished and replaced with employee and public parking, that the present parking lot area be I divided into single lots and sold for residential development. Councilman Kredell stated his objection to parking use for that site. Councilman Seitz spoke in favor of service clubs and private citizen donation for restoration of the building, however suggested that this matter be referred to the Planning Commission for study and a report to I Council. Lengthy discussion followed. Weir moved, second by Kredell, to refer the use of the old police department building to the Planning Commission for study. AYES: Kredell, Laszlo, Seitz, Weir NOES: Gray Motion carried PLANS and SPECIFICATIONS - MUNICIPAL PIER REPAIR Mr. Johnson, City Engineer, reported plans and specifications for immediate repair of the Municipal Pier had been prepared for replacement of nineteen pilings and twenty-four cross-braces, and had been presented for Council consideration. Mr. Johnson reported further that during recent piling maintenance procedures it had been discovered that an additional five pilings and cross-braces in the surf area at the end of the pier are also in need of immediate replacement. Discussion followed. Gray moved, second by Weir, to approve the plans and specifications as presented for the municipal pier repair, to authorize the City Manager to advertise for bids and appropriate an additional $15,000 for replacement of the additional five filings and cross-bracings as recommended. AYES: Gray, Kredell, Laszlo, Weir NOES: Sei tz COMMUNICATION - FRANK HALE - PARKING FEES I Motion carried The City Council discussed the communication from Mr. Prank Hale, Seal Beach Pleasure Fishing, dated April 2, 1979, requesting a reduced rate of parking fees for Seal Beach Pleasure Fishing customers. Council discussed Mr. Hale's request and Kredell moved, second by Weir, to receive and file the communication. AYES: Kredell, Laszlo, Seitz, Weir NOES: Gray ORDINANCE NUIIBER 1062 - MANDATORY RETIREMENT AGE ~Iotion carried I Ordinance Nunlber 1062 was presented to Council for second reading entitled "AN ORDINANCE OF TliE CITY OF SEAL BEACH AMENDING THE CODE RELATING TO MANDATORY RETIREMENT AGE." By unanimous consent, full reading of Ordinance Number 1062 was waived. Weir moved, second by Kredell, to adopt Ordinance Number 1062 as presented. AYES: Gray, Kredell, Laszlo, Seitz, Weir NOES: None Motion carried 4-9-79 3~~l ~Sg~"9-79 RESOLUTION NUMBER 2866 - RECOMMENDING LEGISLATIVE REFORM - WORKERS COMPENSATION and DISABILITY RETIREMENT Resolution Number 2866 was presented to Council entitled "A RESOLUTION OF THE-CITY OF SEAL BEACH, (HEREINAFTER CALLED CITY), CALIFORNIA, RECOMMENDING LEGISLATIVE REFORM IN THE AREAS OF WORKER'S COMPENSATION AND DISABILITY RETIREMENT." By unanimous consent, full reading of Resolution Number 2866 was waived. Kredell moved, second by Weir, to adopt Resolution Number 2866 as presented. AYES: Gray, Kredell, Laszlo, Seitz, Weir NOES: Motion carried None AGENDA AMENDED Laszlo moved, second by Kredell, to amend the agenda to include consideration of a resolution relating to freeway ramp monitoring. AYES: Gray, Kredell, Laszlo, Seitz, Weir NOES: Motion carried None RESOLUTION NUMBER 2867 - OPPOSING INSTALLATION OF FREEWAY RAMP METERING - 405 FREEWAY Resolution Number 2867 was presented to Council entitled "A RESOLUTION OF THE CITY OF SEAL BEACH, CALIFORNIA, DECLARING ITS OPPOSITION TO THE INSTALLATION OF RAMP METERING FOR NORTHBOUND INTERSTATE 405 FREEWAY TRAFFIC,." By unanimous consent full reading of Resolution Number 2867 was waived. Councilman Gray requested that the second paragraph be deleted and that the third paragraph be amended to read 'local streets...... are now seriously congested'... Laszlo moved, second by Weir, to adopt Resolution Number 2867 as amended. AYES: Gray, Kredell, Laszlo, Seitz, Weir NOES: Motion carried None CONSENT CALENDAR Councilman Seitz requested that Item "A: be removed from the Consent Calendar. Weir moved, second by Kredell, to approve the recommended action for items on the Consent Calendar except Item "A" as presented. B., Approved regular demands numbered 31042 through 31236 in the amount of $204,043.95 and payroll demands numbered 32324 through 32351 in the amount of $134,784.73 as approved by the Finance Committee and that warrants be drawn on the Treasury for the same. Denied the claim of David Meyer for personal property damages and referred same to the city's insurance adjuster and carrier. AYES: NOES: Items Removed From the Consent Calendar ITEM "A" - CITY COUNCIL MINUTES Councilman Seitz requested that the minutes be amended to reflect that the additional speed bumps on Seal Way between 10th and 11th Streets be installed by city forces. Seitz moved, second by Weir, to approve the minutes of the regular meeting of March 26, 1979 as ~~ended. AYES: Gray, Kredell, Laszlo, Seitz, Weir NOES: None Motion carried COUNCIL REPORTS and REQUESTS Councilman Kredell expressed thanks to the Public Works Department for the beach cleaning, early removal of the sand berm and the prompt action being taken for installation of speed bumps on Seal Way. Councilman Gray stated that he would be absent from the second meeting in May and moved to consider City Council reorganization at the first meeting in May. Councilman Seitz seconded the motion. AYES: NOES: Gray, Kredell, Laszlo, Seitz, Weir None Motion carried Councilman Seitz requested more tree limbs and leaves be removed from the Gum Grove Park area and spoke regarding the diseases affecting the Gum Grove trees. The City Engineer reported that specimens of the diseased trees had been 'sent to the County of Orange for study. The City Engineer also reported that during the month of August he hoped to have California Conservation Corp personnel performing extensive clean up of the Gum Grove Park area. Councilman Seitz referred to the Coastal Conservancy report and stated for the record "I would like to go on record, I received today ,0.<1'04.,9-79 '~IU 'I in the mail the Fact Recommendation that the Coastal Conservancy is going to present and on the last page, page five, there is a statement that low cost housing is being reconstructed in the Marina Trailer Park and is expected to built as a significant portion of the new development on the Hellman-Rockwell property a quarter mile up river. The sacrifice of the Hellman property and the structures in my district for the I benefit of DWP and I am not in agreement with and I am not willing to sacrifice a portion of my district under these conditions when there are other alternatives available". The City Manager reported receipt of a communication from Lusk/Hellman stating that their partnership for the development of the Hellman property had been dissolved, that Hellman was discussing development of that property with other developers and would continue to keep the city informed of their plans. The City Manager and City Engineer reported a communication had been received from a Leisure World resident requesting bus service be provided to the downtown area. The City Engineer the Orange County Transit District had indicated they would include that route in their schedule if the city would provide one, additional bus stop. Gray moved, second by Weir, to approve one additional bus stop I at 8th Street and Ocean Avenue, as reque~ted.
