ROLL CALL Present: Mayor Seitz Councilmen Gray, Kredell, Laszlo, WeiT Absent: None Also present: Mr. Courtemarche, City Manager Mr. Coughlan, City Attorney Mr. Johnson, City Engineer t~r. Romaniello, Planning Director Capt. Picascia, Police Department Mr. Thomas, Finance Director Mr. Kosmont, Assistant City Manager It was the order of the Chair with consent of the Council, to recess the meeting to the Redevelopment Agency meeting, to reconvene after Agency adjournment. The meeting recessed at 7:34 p.m. The City Council meeting reconvened at 7:50 p.m. with Mayor Seitz I calling the meeting to order. WAIVER OF FULL READING Weir moved, second by Laszlo, to waive the reading in full of all ordinances and resolutions, and that consent to the waiver of reading shall be deemed to be given by all Council members after reading of the title unless specific request is made at that time for the reading of such ordinance or resolution. AYES: Gray, Kredel1, Laszlo, Seitz, Weir NOES: None Motion carried PUBLIC HEARING - BUILDING and SAFETY CODE Mayor Seitz declared the public hearing open to consider adoption of a revised Building and Safety Code of the City of Seal Beach. The City I Clerk certified that notices had been published as required by law and that no communications had been received either for or against the matter. The City Engineer presented the staff report and recommended adoption of the new Building and Safety Codes. There were no communica- tions from the audience for or against the matter; Mayor Seitz declared the public hearing closed. ~ 2-25-80 ORDINANCE NUMBER 1079 - ADOPTING BUILDING and SAFETY CODE Ordinance Number 1079 was presented for second reading entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, AMENDING CHAPTER 5 OF THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA, RELATING TO BUILDING AND SAFETY, ADOPTING BY REFERENCE THE UNIFORM BUILDING CODE, 1979 EDITION, INCLUDING THE APPENDIX, UNIFORM MECHANICAL CODE, 1979 EDITION, UNIFORM PLUMBING CODE, 1979 EDITION, UNIFORM SWIMMING CODE, 1979 EDITION, UNIFORM HOUSING CODE, 1979 EDITION, UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, 1979 EDITION, UNIFORM SIGN CODE, 1979 EDITION, DWELLING CONSTRUCTION UNDER THE UNIFORM BUILDING CODE, 1979 EDITION, ONE AND TWO FAMILY DWEL~ING COQE, ACCUMULATIVE SUPPLEMENT, 1979 EDITION, NATIONAL ELECTRICAL CODE, 1978 EDITION, UNIFORM BUILDING CODE STANDARDS, 1979 EDITION, UNIFORM FIRE CODE, AND UNIFORM WIRING CODE, AND UNIFORM SOLAR ENERGY CODE, 1979 EDITION, AND REPEALING ORDINANCE NO. 994, AS AMENDED." AYES: Gray, Krede11, Laszlo, Seitz, Weir NOES: None Motion carried PUBLIC HEARING - TENTATIVE TRACT MAP 10695 (127-129 Second Street) Mayor Seitz declared the public hearing open to consider proposed Tentative Tract Map 10695 for property located at 127-129 Second Street. The City Clerk certified that notices had been published and mailed as required by law and that no communications had been received either for or against the matter. The Planning Director presented the staff report and recommendations of the Planning Commission. Mr. Romaniello stated the applicant had requested modification for payment of the in lieu parkland fees for the project. The Planning Director reported the City Attorney had reviewed the request and had recommended that 1) an agreement be drafted establishing a time certain as to when the in lieu fees would be paid; and 2} the City Council review and approve a "concept of delay of payment" by resolution. Mr. Kent .Sanders, speaking on behalf of the developer, stated their willingness to comply with the conditions I I I 2-25-80 :tea as set forth. There were no other commwlications; Mayor Seitz declared the public hearing closed. RESOLUTION NUMBER 2950 - APPROVING TENTATIVE TRACT MAP 10695 - (127-129 Second Street) I Resolution Number 2950 was presented to Council entitled "A RESOLUTION OF THE SEAL BEACH CITY COUNCIL APPROVING TENTATIVE TRACT MAP 10695". By unanimous consent, full reading of Resolution Number 2950 was waived. Krede11 moved, second by Laszlo, to adopt Resolution Number 2950, approving Tentative Tract Map No. 10695 subject to I} payment of $43,904 in lieu parkland subdivision fees by September 1, 1980 subject to an agreement between the applicant and City approved by the City Attorney; and 2} any delay in payment subject to City Attorney's approval. AYES: Gray, Krede11, Laszlo, Seitz, Weir NOES: None Motion carried ORDINANCE NUMBER 1080 - REQUIRING RETAIL GROCERY STORE ITEM PRICING Ordinance Number 1080 was presented to Council for second reading I entitled "AN ORDINANCE OF THE CITY OF SEAL BEACH REQUIRING ITEM PRICING IN RETAIL GROCERY STORES AND AMENDING THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA." By unanimous consent, full reading of Ordinance Number 1080 was waived. Weir moved, second by Gray, to adopt Ordinance Number 1080 as presented. AYES: Gray, Krede11 , Laszlo, Seitz, Weir NOES: None Motion carried RESOLUTION NUMBER 2951 - ESTABLISHING BUILDING VALUATION DATA and MISCELLANEOUS FEES Resolution Number 2951 was presented to Council entitled :'A RESOLUTION OF THE CITY COUNCIL OF THE :::ITY OF SEAL BEACH ESTABLISHING BUILDING VALUKfION ~ATA AND MISCELLJ~EOUS FEES AND RESCINDING RESOLUTION NO. 2790." 8y unanimous consent, full reading of Resolution N~~ber 2951 I was waived. Weir moved, second by Gray, to adopt Resolution Number 2951 as presented. AYES: Gray, Krede11, Laszlo, Weir NOES: Seitz Motion carried CONSENT CALENDAR Weir moved, second by Gray, to approve the recommended action for ~f 2-25-80 items on the Consent Calendar as presented. A. Approved the minutes of the regular meeting of February 11, 1980. B. Approved regular demands numbered 34982 through 35102 in the amount of $345,594.03; payroll of February 14, 1980 and demands numbered 32662 through 32668 in the amount of $137,704.38 as approved by the Finance Committee and that warrants be drawn on the Treasury for the same. C. Approved the Corporation Grant Deed dedicating Regency Drive to the City of Seal Beach. D. Received and filed the letter from Michael I Graziano, City Manager, City of Los A1amitos, regarding their continued support to cooperate with the city of Seal Beach in the proposed development of the Lampson Park Site. AYES: Gray, Krede11, Laszlo, Seitz, Weir NOES: None Motion carried REPORT - 8EACH TRASH RECEPTACLES I The City Manager reported that Coppertone (Plough, Inc.) had agreed to provide beach trash receptacles, at no cost to the city, without the 'little girl and dog' logo, in response to concerns expressed by some residents of the community. Mr. Courtemarche stated the City of Seal Beach will realize an annual saving of approximately $1000 through participation in this trash receptacle program, and reported several other cities and counties have approved this program for their beaches. Gray moved, second by Weir, to authorize the City Manager to execute the agreement with Plough, Inc. (Coppertone) to provide beach trash receptacles. A member of the audience expressed concern regarding advertising being allowed on the beach and questioned the legal III implications for the city. The City Attorney explained there are no legal implications and that the agreement is for a term of one year and the program may be opened to competitive bidding upon termination of the agreement. With consent of the Council, a revote of the motion was taken, as requested by Councilman Weir. AYES: Gray, Weir NOES: KredeU, Laszlo, Seitz Moti.on failed The City Attorney explained a motion to reconsider the matter must be made by the prevailing side. Lengthy discussion continued. Councilman Krede11 stated he would be willing to discuss this matter further at a Seal Way residents meeting and that the representative of Plough, Inc. attend this meeting. Mr. Krede11 stated he would report back to Council. REPORT - PLANNING DEPARTMENT CLERICAL REQUEST The Planning Director presented the staff report requesting that the Planning Department be allowed to include a clerical position in the 1979-80 fiscal year budget and requested recruitment to fill that position begin as soon as possible. Councilman Gray stated he could only support the request for additional clerical help if personnel costs in another area were reduced by that amount. Mayor Seitz recommended consideration of a clerk-typist rather than a secretarial position. Discussion followed. Gray moved, second by Laszlo, that consideration of this request be delayed for two weeks pending an evaluation by the City Manager of adding this clerical position. AYES: Gray, Krede11, Laszlo, Seitz, Weir NOES: None Motion carried REPORT - OLD POLICE BUILDING AND CITY OWNED PROPERTY The Planning Director presented the staff report regarding the potential for preservation or utilization of the old police department building and property. The Planning Director stated several public meetings had been held to discuss possible use of the facility, that sources of grant funds or loans for restoration of the building had been pursued and Teported that all funding attempts have been I I i@S 2-25-80 unsuccessful to date. The Planning Director reviewed a Council proposal to subdivide for development the present city hall parking area, with the old police facility property being utilized for city parking, estimates of potential revenue to the city from such a development were presented for discussion. Discussion followed regarding historical registration of the building and continued search for grant funds. It was the consensus of the Council that no action be taken at this time regarding this matter. COUNCIL REPORTS and REQUESTS Councilman Krede11 requested additional animal control on the beach, and discussed truck parking on Pacific Coast Highway. The City Attorney reported the State has jurisdiction for regulations on state highways, and that parking of trucks is not restricted. Mr. Krede11 Teported a complaint regarding noise from an apartment complex on Ocean Avenue, and inquired about the number of residents allowed inap!rtments on Seal Beach Boulevard. The City Engineer reported that Seal Beach will be applying for disaster relief funds for beach cleanup and stated he would try to include a beach erosion request within that application, as requested by Councilman Kredell. Mr. Kredell noted the need for sand replenishment on the beach. The City Engineer responded that sand may be obtained from the Navy dredging within 1~ to 2 yeaTs and possibly at no cost to the city. Councilman Weir reported on Vector Control meetings, and cautioned residents of the Trailer Park about possible rodent infestation. Councilman Gray suggested that some items presented during Council Reports and Requests could be more efficiently handled and answered directly through the City Manager and staff. Councilman Laszlo and the City Engineer reported the necessity of street maintenance and repair in the College Park East area, this item to be considered at next meeting. I I ORAL COMMUNICATIONS Mayor Seitz declared oral communications open from the audience. A lady I in the audience inquired about taxi and bus service in the city for elderly citizens. Councilman Laszlo inquired about pTogress of . investigation into cable TV for Seal Beach.
