WAIVER OF FULL READING Seitz moved, second by Laszlo, to waive reading in full of all ordinances and resolutions, and that consent to the waiver of reading shall be deemed to be given by all Council members after reading of the title unless specific request is made at that time for the reading of such ordinance or resolution. ORDINANCE NUMBER 1095 - AMENDING ZONING CODE - BUILDING HEIGHT REGULATIONS - SMALL NONCONFORMING LOTS Ordinance Number 1095 was presented to Council for second reading I entitled "AN ORDINANCE OF THE CITY OF SEAL BEACH CONCERNING BUILDING HEIGHTS ON SMALL LOTS AND AMENDING THE SEAL BEACH CITY CODE." By unanimous consent, full reading of Ordinance Number 1095 was waived. Seitz moved, second by Laszlo, to adopt Ordinance Number 1095 as presented. AYES: Kredell, Laszlo, Seitz, Supple NOES: None ABSENT: Vanderstaay Motion carried PROPOSED ORDINANCE NUMBER 1096 - FRANCHISES - CABLE TELEVISION SYSTEMS Proposed Ordinance Number 1096 was presented to Council entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH AMENDING CHAPTER 23A OF THE SEAL BEACH MUNICIPAL CODE RELATING TO THE GRANTING OF I FRANCHISES FOR CABLE TELEVISION SYSTEMS." Mr. Joseph, Assistant City Manager, presented the staff report, reviewed alternatives available to the city in providing cable television to the community, and reviewed the proposed ordinance governing cable television franchises. The City Manager stated that the City Attorney had recommended certain changes be made to the proposed ordinance and 'suggested that consideration of the ordinance be postponed until next meeting in order to include those amendments, that the Council only consider authorizing the staff to solicit proposals for a cable television franchise at this time. Councilman Seitz suggested that additional amendments be considered: (1) that Section 23A-4 (11), Test and Compliance Procedure, include a time frame for subsequent service tests, and recommended sixty (60) days; (2) that I Section 23A-4 (11) also include provision for a third failure, which would result in a loss of the franchise based on the grantees inability to deliver an acceptable product to the consumer which would result in a financial loss to the city; and (3) that Section 23A-7 (2) include provision requiring the grantee to submit a formula for computation of rates to be established subsequent to the initial two year program. ~~ . . 4-27-81 Councilman Laszlo inquired as to who would perform the test for perfor- mance standards. The City Manager stated the grantee would perform the actual tests and produce the results to the city, and that it is assumed a technician would be retained on behalf of the city to oversee the testing procedures, review and verify the results. Councilman Seitz indicated he would like a report from the Board of Directors of the PCTA indicating their ability to match any proposal under consideration by the city. Councilman Supple referred to ownership of the cable system after a specified franchise period and inquired if it would be beneficial to request proposals on that basis. It was clarified the system ownership is a concept of the PCTA. Discussion continued; no action was taken to include an ownership provision in the application form. Seitz moved, second by Laszlo, to authorize the City Manager to solicit proposals for the provision of a cable television franchise for the City of Seal Beach. AYES: Kredell, Laszlo, Seitz, Supple NOES: None ABSENT: Vanderstaay Motion carried Mr. Paul Jeffers, Trailer Park resident, spoke in opposition to the adoption of Ordinance Number 1095, limiting building heights. CONSENT CALENDAR Councilman Seitz requested Items "E" and "L" removed from the Consent Calendar; Councilman Laszlo requested Item "G" removed from the Consent Calendar; Mayor Kredell requested Item "H" removed and a member of the audience requested Item "0" removed. Seitz moved, second by Laszlo, to approve the recommended action for items on the Consent Calendar as presented except Items liE, G, H, L, and 0". F. Approved regular demands numbered 39860 through 39999 in the amount of $253,219.30; payroll of April 23, 1981 plus demands numbered 32960 through 32977 in the amount of $148,475.08 as approved by the Finance COllDlli ttee and that warrants be drawn on the Treasury for the same. I. Received and filed the letter from the State of California, Office of the Treasurer, regarding the I I I 4-27-81 3~ I Seal Beach Redevelopment Agency's application for a $75,745.00 loan from the Local Agency Indebtedness fund, which concludes that the Seal Beach Redevelopment Agency does not qualify for a loan at this time. J. Received and filed the report from Director of Planning regarding the Coastal Commission meeting of April 14, 1981. K. Authorized the City Manager to accept the proposal of Diehl, Evans and Company to conduct the annual audit. M. Authorized the City Manager to fill the vacant position of Water Meter Reader in the Public Works Department. N. Authorized the City Manager to execute the agreement with the County of Orange to provide for Animal Shelter Services, commencing July I, 1981 for an indefinite term. AYES: Kredell, Laszlo, Seitz, Supple NOES: None ABSENT: Vanderstaay Items Removed From the Consent Calendar Motion carried I I ITfM "E" - CITY COUNCIL MINUTES Councilman Seitz stated he would abstain from voting on the approval of the minutes as he was absent from the April 13, 1981 meeting. Laszlo moved, second by Kredell, to approve the minutes of the March 21, 1981 special adjourned meeting and the April 13, 1981 regular meeting as presented. AYES: Kredell, Laszlo, Supple NOES: None ABSTAIN: Seitz ABSENT: Vanderstaay Motion carried ITEM "G" - AGREEMENT - OLD TOWN BUSINESS ASSOCIATION - PARKING Councilman Laszlo stated he felt the $25 per year parking fee under this agreement was inadequate and suggested $25 per month. The City Manager stated that the previous agreement had expired March 31st and . ':h 40U.4-27-81 that it was his intent to study the overall parking problem prior to suggesting any adjustment of existing rates. It was clarified these parking spaces are for downtown merchants and their employees only. Concern was expressed with retaining the $25 annual rate for the next twelve month period; the City Manager suggested the agreement be amended to reflect a termination date of September 30th. Supple moved, second by Laszlo, to approve the agreement with the Old Town Business Association to provide parking spaces in the Eighth Street/Central Avenue parking lot as amended reflecting a termination date of September 30, 1981 and that the City Manager provide a parking survey prior to that date. AYES: Kredell, Laszlo, Seitz, Supple NOES: None ABSENT: Vanderstaay Motion carried ITEM "H" - AGREEMENT - C & C BOATS, INC. Mayor Kredell suggested that the city operation of the tram be eliminated from the services provided by this agreement, that C & C Boats assume responsibility for that service. The Assistant City Manager explained that providing the tram service is included in the daily charge for services other than parking. Mayor Kredell also requested that the charge for the parking spaces be revised to be more reflective of the current rates. Councilman Supple suggested that the City Manager review the contract with those suggestions in mind and report back to Council. It was the consensus of the Council to hold this item over to next meeting. ITEM "L" - MAYORS and COUNCILMEMBERS LEGISLATIVE CONFERENCE Councilman Seitz stated he requested this item removed as he did not favor the requested authorization. Laszlo moved, second by Kredell, to authorize the attendance of Councilmember Vanderstaay at the Mayors and Councilmembers Legislative Conference, May 11 through May 13, 1981 in Sacramento and that $322 be appropriated to cover the estimated cost. AYES: Kredell, Laszlo, Supple NOES: Seitz ABSENT: Vanderstaay Motion carried I I I 4-27-81 4.9~ I ITEM "0" - REQUEST - GRACE BRETHREN CHURCH - BEACH PARKING LOT USE Mr. Tom Blackman, 421 Beryl Cove Way, spoke regarding the use of the Eighth Street Beach Parking Lot by members of the Grace Brethren Church during Sunday morning services, the parking fee to be charged, the method of payment to the city and availability of the Eighth/Central parking lot. Members of the staff responded to Mr. Blackman's questions. Council briefly discussed reduced parking lot rates for residents. Kredell moved, second by Seitz, to allow parishoners of the Grace Brethren Church to utilize the Eighth Street Beach Parking Lot during Sunday morning services in accordance with the following procedures: I) parking spaces may be utilized between 8:00 a.m. and noon each Sunday; 2) the Church will provide an identification to its members to distinguish Church members from beach goers; 3) the lot attendant will keep a record of all authorized church cars entering the lot, and report Church usage to the Police Department with the daily report; and 4) the Finance Department will be notified of the vehicle count and charges and bill the Church accordingly; the Church will remit to City on monthly basis. AYES: Kredell, Laszlo, Seitz, Supple NOES: None ABSENT: Vanderstaay COUNCIL REQUESTS OF THE CITY MANAGER and REPORTS Motion carried I I Councilman Seitz moved to direct the staff to prepare an ordinance that would provide for regulation of noise generated from the redrill of oil wells, the ordinance to be presented Council for consideration within ninety days. Mayor Kredell seconded the motion. AYES: Kredell, Laszlo, Seitz, Supple NOES: None ABSENT: Vanderstaay Motion carried Councilman Seitz moved to direct the staff to prepare an ordinance requiring new subdivisions greater than fifty units to provide either land or in-lieu fees for educational institutions, said ordinance to be presented Council for consideration within sixty days. C. House Subcommittee on Aviation over the Mayor's signature, opposing any joint aviation use of Los Alamitos Reserve Center. AYES: Krede11, Laszlo, Seitz, Supple NOES: None ABSENT: Vanderstaay Motion carried Mayor Kredell referred to the recently leased Exxon Company site at First Street and Marina Drive and reported residents adjacent to that site had requested landscaping be provided to screen the tanks on that site. The City Manager stated he would prepare a letter to the Exxon Company and forward the request. ORAL COMMUNICATIONS Mayor Kredell declared oral communications open from the audience. Christine Agur, Cottonwood Lane, expressed opposition to the adopted ordinance limiting building heights. Joyce Risner, 845 Driftwood Avenue, opposed Ordinance Number 1095, supported retention of the pier tram, Objected to one hour parking regulation on Main Street for local residents and recommended parking be increased to two hours, and suggested an increase of the oil'barrel tax. Mr. E. Clute, 4 Cottonwood Lane, spoke regarding the Trailer Park rent subsidy payments, regulations imposed by Ordinance Number 1095, low cost housing requirements under the Coastal Commission, and regulations regarding parking citations in the Trailer Park. Tom Blackman, 421 Beryl Cove, suggested the residential parking sticker may provide a qualification for two hour parking on Main Street. Mr. Blackman also requested that the Council establish a reward fund for the arrest and conviction of certain criminals. Councilman Seitz stated he had previously requested information regarding a reward fund; the City Manager stated he would provide a report at next meeting. There were no other oral communications; Mayor Kredell declared oral communi- cations closed.
