Ingram, Acting City Manager FROM: Mark Persico, AICP, Director of Development Services SUBJECT: ADDITION OF ALTERNATE MEMBERS TO THE ENVIRONMENTAL QUALITY CONTROL BOARD SUMMARY OF REQUEST: Introduce Ordinance No. 1607 to allow appointment of alternate members to the Environmental Quality Control Board (EQCB). BACKGROUND: Per the direction of the City Council, attached is a draft ordinance that, if adopted, would allow appointment of alternate members to the Environmental Quality Control Board (EQCB). FINANCIAL IMPACT: There are no fiscal impacts associated with adoption of the Ordinance. ANALYSIS: Pursuant to Municipal Code Section 3.10.005 the EQCB is comprised of 5 members that serve 4 year terms. Further Section 802 of the City Charter states: "each Council member shall nominate one member to boards and committees. Such nominations shall be confirmed by at least three affirmative votes of the City Council." However, neither the Municipal Code nor Charter prohibits appointment of additional members; nor in fact, the Recreation and Parks Commission can have Ex Officio, non - voting, members in accordance with Municipal Code Section 3.10.015. In this case staff is suggesting the addition of alternate members with voting powers only when the primary member is absent. This will maintain the voting balance between City Council Districts. Appointment of an alternate will also Agenda Item A Page 2 assure better representation for each Council District, because the alternate will vote when the primary member cannot. RECOMMENDATION: That the City Council introduce Ordinance Number 1607 to allow appointment of alternate committee members to the Environmental Quality Control Board. SUBMITTED BY: Mark H. Section 3.10.005 of the Seal Beach Municipal Code is hereby amended to read as follows: "B. Composition 1. The environmental quality control board shall consist of 5 voting members, and up to 5 alternates. The members and alternates of the board shall be appointed and subject to removal in accordance with the city charter. The term of membership on the board shall be 4 years. 2. The alternate may only vote when the voting board member is not in attendance. SECTION 2. The City Clerk shall certify to the adoption of this ordinance.
