City Clerk and ex-officio clerk of the Seal Beach City Council Seal Beach, California October 10, 1977 I The City Council of the City of Seal Beach met in regular session at 8:16 p.m. with Mayor Blackman calling the meeting to order with the Salute to the Flag. A. Brown, Manager, Automobile Club of Southern California, presented the Pedestrian Safety Citation Award to the City of Seal Beach. Mayor Blackman accepted the award on behaU of the City and thanked Mr. B-rown for his presentation. Mayor Blackman requested that the Resolutions honoring Seal Beach Eagle Scouts be brought out of order for presentation at this time. RESOLUTION NUMBER 2699 - HONORING MICHAEL JOHN RUSH - EAGLE SCOUT Resolution Number 2699 was presented to Council and read in full by the Mayor entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, HONORING AND COMMENDING MICHAEL JOHN RUSH FOR ACHIEVING THE BOY SCOUTS OF AMERICA EAGLE AWARD." Kredell moved, second by Laszlo, to adopt Resolution Number 2699 as presented. I AYES: Blackman, Kredell, Laszlo NOES: None ABSENT: Gray, Weir Motion carried RESOLUTION NUMBER 2692 - PRESENTATION - MITCHELL JONATHAN SIMON - EAGLE SCOUT Councilman Laszlo read Resolution Number 2692 in full honoring Mitchell Jonathan Simon for achieving the Boy Scouts of America Eagle Award, said Resolution having been adopted by the City Council on September 12, 1977. Mayor Blackman and Councilman Laszlo presented the resolutions to Michael John Rush and Mitchell Jonathan Simon with congratulations and a round of applause for their achievements. WAIVER OF FULL READING I Laszlo moved, second by Kredell, to waive the reading in full of all ordinances and resolutions, and that consent to the waiver of reading shall be deemed to be given by all Council members after reading of that title unless specific request is made at that time for the reading of such ordinance or resolution. -" ~," .~. 10-10-77 AYES: Blackman, Kredell, Laszlo NOES: None ABSENT: Gray, Weir Motion carried PUBLIC HEARING - UNCLASSIFIED USE PERMIT and PLANNED UNIT DEVELOPMENT - SEAL BEACH TRAILER PARK Mayor Blackman declared the public hearing open to consider an unclassified use permit for a Mobile Home Park and a Planned Unit Development for townhouses. The City Clerk certified that notices had been published and mailed as required by law and that no communications had been received either for or against the matter. Laszlo moved, second by Kredell, to continue the public hearing regarding UUP-1-77 and PUD-2-77 until Tuesday, October 25, 1977 at 8:00 o'clock p.m. , AYES: Blackman, Kredell, Laszlo NOES: None ABSENT: Gray, Weir Motion carried TENTATIVE TRACT MAP NO. 9783 Laszlo moved, second by Blackman, to set Tuesday, October 25, 1977 at 8:00 o'clock p.m. as the time for consideration of Tentative Tract Map 9783. AYES: Blackman, Kredell, Laszlo NOES: None ABSENT: Gray, Weir Motion carried APPOINTMENTS - PROJECT AREA COMMITTEE Mayor Blackman moved to hold over the appointments to the Project Area Committee until next meeting and that the present members continue to serve on the Committee until said appointments have been made. Councilman Krede11 seconded the motion. AYES: Blackman, Kredell, Laszlo NOES: None ABSENT: Gray, Weir Motion carried PROCLAMATION Mayor Blackman proclaimed the week of October 9 through October 15, 1977 as "Fire Prevention Week." ORDINANCE NUMBER 1019 - NEWSRACK ORDINANCE AMENDMENT Ordinance Number 1019 was presented to Council for second reading by I I I 10-10-77 I title "AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING THE MUNICIPAL CODE PERTAINING TO NEWSRACKS AND AMENDING THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA." By unanimous consent, full reading of Ordinance Number 1019 was waived. Blackman moved, second by Kredell, to adopt Ordinance Number 1019 as presented. AYES: Blackman, Krede11 , Laszlo NOES: None ABSENT: Gray, Weir Motion carried PROPOSED ORDINANCE - FIREWORKS Blackman moved, second by Laszlo, to hold over consideration of the proposed ordinance prohibiting the sale and use of fireworks until the next meeting. AYES: Blackman, Kredell, Laszlo NOES: None ABSENT: Gray, Weir Motion carried ORDINANCE NUMBER 1021 - EXCISE TAX ORDINANCE AMENDMENTS Ordinance Number 1021 was presented to Council for first reading by title "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, AMENDING CERTAIN SECTIONS AND ADDING CERTAIN PROVISIONS TO ARTICLE III OF CHAPTER 22, EXCISE TAX, OF THE CODE OF THE CITY OF SEAL BEACH." By unanimous consent, full reading of Ordinance Number 1021 was waived. Mr. Neprud presented the staff report and requested two changes in the proposed ordinance, the addition of "Excise Tax" in the ordinance title and revision of Section 5 as recommended by the City Attorney. Mr. Neprud stated that the purpose of the proposed ordinance was to clarify certain wording in the existing Excise Tax Ordinance. Laszlo moved, second by Kredell, to approve the introduction of Ordinance Number 1021 as amended and that it be passed to second reading. Blackman moved, second by Kredell, to hold over the proposed resolution establishing salary rates until next meeting as requested. AYES: Blackman, Kredell, Laszlo NOES: None ABSENT: Gray, Weir Motion carried RESOLUTION NUMBER 2700 - REQUESTING COASTAL ZONE MANAGEMENT PLANNING ASSISTANCE Resolution Number 2700 was presented to Council by title "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH REQUESTING COASTAL ZONE MANAGEMENT PLANNING ASSISTANCE." By unanimous consent, full reading of Resolution Number 2700 was waived. Mr. Neprud, Planning Director, stated that the proposed resolution requested planning assistance and financial assistance in the amount of $3,677 for the initial preparation of the Local Coastal Program which is required to be prepared by coastal cities by State law. Blackman moved, second by Laszlo, to adopt Resolution Number 2700 as presented. AYES: Blackman, Kredell, Laszlo NOES: None ABSENT: Gray, Weir-' Motion carried CONSENT CALENDAR Councilman Kredell requested that Item "E" be removed from the Consent Calendar; members of the audience requested Items "I" and "G" be removed from the Consent Calendar. Laszlo moved, second by Blackman, to approve the recommended action for items on the Consent Calendar except Items "E", "G" and "I" as presented. A. Approved the minutes of the regular meeting of September 12, 1977 as presented. B. Approved regular demands numbered 24845 through 25181; payroll demands of September 15, 1977 I I I I numbered 22805 through 23071 in the amount of $131,665.10 and payroll demands of September 29, 1977 numbered 23072 through 23310 in the amount of $113,620.74, as approved by the Finance Committee and that warrants be drawn on the Treasury for the same. Denied the claim of Richard Stackpole, Patricia Sidock and Sherry Christensen for general damages and referred same to the city's insurance carrier. D. Denied the claim of Timothy J. Palmer for general and special damages and referred same to the city's C. I insurance carrier. F. Approved the Motorcycle Maintenance and Repair Agreement between the City of Seal Beach and the City of Huntington Beach and authorized the Mayor to execute the Agreement on behalf of the city. H. Approved the specifications for complete exterior painting and interior painting as specified for Fire Station No.3, 3131 Beverly Manor Road and authorized the City Manager to accept bids. J. Received and filed the Notice from the Public Utilities Commission regarding application No. 57232 of Southern California Gas Company to increase revenue requirements of long-term storage pursuant to a proposed subsection (0) Gas Storage Adjustment (GSA) to Southern California Gas Company's Rule No.2. Received and filed the Notice from the Public K. I Utilities Commission regarding application No. 57578 of Southern California Gas Company to authorize (1) increase rates for gas service to offset the costs associated with 1978 voluntary load reduction plan, (2) establish a conservation adjustment account and (3) implement major customer incentive programs. 10-10-77 -' - '- 10-10-77 '. AYES: Blackman, Kredell, Laszlo NOES: None ABSENT: Gray, Weir Motion carried Items Removed From The Consent Calendar ITEM "E" - PURCHASE OF LIFEGUARD VEHICLE I Councilman Kredell stated his objection to the purchase of a lifeguard vehicle at this time. It was the consensus of the Council that no action be taken on this item at this time. 'Councilman Laszlo requested that this matter not be placed on the Consent Calendar if it is considered in the future. ITEM "G" - REQUEST - SEAL BEACH BAND REVIEW Adah Winters, 1507 Electric Avenue, requested that the City provide additional restroom facilities on the day of the Band Review. Councilman Kredell suggested the staff investigate using the Navy property for parking of the buses. Blackman moved, second by Kredell, to approve the 11th Annual Seal Beach Junior High School Band Review at 11:00 a.m., November 12, 1977, as requested by Mr. Charles Wackerman. AYES: I' Blackman, Kredell, Laszlo NOES: None ABSENT: Gray, Weir Motion carried ITEM "I" - ENVIRONMENTAL QUALITY CONTROL BOARD RESOLUTION - LOCAL STEAM PLANTS Mr. Nelsen, Chairman of the Environmental Quality Control Board spoke regarding pollutants from local steam plants causing property damage effecting Seal Beach residents and suggested that the City Council pursue this matter with the utility companies. Councilman Laszlo asked tha~ this matter be held over for discussion with Mr. Gray, as Councilman from the Leisure World area which is the area most effected. The City Attorney recommended that the city not pursue action against the utility companies regarding this matter, stating that complaints could be initiated by citizens on an individual basis. Mr. Compton, 1 Southern California Edison Company, Huntington Beach, stated that a study is underway to determine the chemical damage, if any, resulting from the Los Angeles Department of Water and Power Haynes Steam Plant and the Southern California Edison Company Alamitos Steam Plant 10-10-77 ~ , emissions. Mr. Compton referred to other environmental conditions in the area that may effect the emissions from these plants. Mr. Compton stated that representatives from the Edison Company would be willing to meet with the E.Q.C.B. for discussion of this matter. 1 Kredell moved, second by Laszlo, to hold over further discussion of this item until next meeting. CHURCHILL Mr. Neprud, Planning Director, presented the staff report, reviewing the background of this appeal and the Planning Commission actions. In response to a querie by Mayor Blackman, Mr. Neprud reported that the proposed addition would increase the lot coverage to 41.59% or 84.4 square feet in excess of the maximum permitted lot coverage. Mr. Churchill assured the Council that he had no plans to enlarge the existing patio area of his home. Laszlo moved, second by 1 Blackman, to approve Appeal A-3-77 of Forest R. Churchill as presented. AYES: Blackman, Kredell, Laszlo NOES: None ABSENT: Gray, Weir Motion carried Mr. Neprud stated that a resolution would be presented to Council at next meeting affirming this City Council action. The Council again spoke in favor of the Planning Commission studying increased allowable lot coverage for the College Park East and the College Park West areas. COUNCIL REPORTS and REQUESTS Mayor Blackman requested that the Acting City Manager report in the next Newsletter regarding the feasibility of constructing sidewalks on the north side of Pacific Coast Highway using H.C.D. funds. In I response to Councilman Kredell's requests, Acting City Manager Little stated that the Newsletter would have reports on the portable sign in the Pier area, trailers on 17th Street, the Navy property adjacent to Surfs ide and that the Traffic Committee would review red parking zones on Main Street. The staff was directed to investigate possible parking areas for recreational vehicles. Ed Chilcott, 1720 Crestview Avenue, requested information as to responsibility of sidewalk maintenance. -- 10-10-77 I 10-25-77 '. The City Engineer responded that the State Government Code reads that it is the responsibility of the property owner. Jean Dorr, 231 _ 6th Street, spoke regarding low and moderate income housing in Seal Beach. Council discussed the availability of grant funds to refurbish the old police facility.
