SUBJECT: ACCEPTING PUBLIC IMPROVEMENTS AND
AUTHORIZING THE RELEASE OF SECURITY FOR
CENTEX HOMES TRACT NO. 15797
SUMMARY OF REQUEST:
The proposed City Council Action will adopt the attached Resolution accepting the
public improvements completed as part of Centex Homes Tract No. 15797, which is
located on the easterly side of Seal Beach Boulevard at Plymouth Drive/Rossmoor Center
Way, which have been completed in a satisfactory manner, and will approve the release
of the subdivision Faithful Performance Bond and Monument Bond which were posted to
guarantee completion of the required improvements and the setting of survey monuments
for the tract, and will reduce the Labor and Material Bond to $450,000 and keep in force
the reduced Labor and Material Bond and Warranty Bond for one year from the date of
the Council acceptance of public improvements.
BACKGROUND:
A subdivision agreement for Tract 15797 was entered into between the City of Seal
Beach and Centex Homes dated April 23, 2001, which required that certain
improvements be installed and that survey monuments be set in accordance with the
recorded subdivision map for Tract 15797. The subdivider posted a Faithful Performance
Bond, Labor and Materials Bond, Monument Bond, and Warranty Bond with the City to
guarantee the installation of required improvements and the setting of survey monuments.
The City Engineer has provided the attached "City of Seal Beach Certification of
Completion of Subdivision Public Improvements and Recommendation to Release
Security Related to Centex Homes Tract No. 15797" certifying that all public
improvements and survey monuments related to Centex Homes Tract No. 15797, have
been completed in a satisfactory manner and recommends acceptance of the public
improvements and the release of the following bonds:
1. Faithful Performance Bond No. 6111100 in the amount of $936,786.85 provided by
Safeco Insurance Company of America.

2. Monument Bond No. 6111102 in the amount of $17,500.00 provided by Safeco
Insurance Company of America.
The City Engineer additionally recommends that the following bonds, reduced as noted,
remain in effect for one (1) year from the date of approval of the Council resolution
accepting public improvements and releasing bonds for Centex Homes Tract No. 15797
in order to provide for repair of defective work and to provide security for labor and
material claims that may be filed against the City of Seal Beach, and which bonds at the
end of this one (1) year period would be automatically exonerated and released at that
time unless during which time the City Council of the City of Seal Beach by resolution
modifies such exoneration and release:
1. Labor and Materials Bond No. 6111100 in the amount of $936,786.85 provided
by Safeco Insurance Company of America, reduced to $450,000.00.
2. Warranty Bond No. 6111101 in the full original amount of $23,419.71 provided
by Safeco Insurance Company of America.
FISCAL IMPACT:
No impact. Costs are recovered through fees collected from the subdivider for the
processing of subdivision documents.
RECOMMENDATION:
Upon motion of the consent calendar, it is recommended that the City Council adopt the
attached resolution accepting the public improvements and releasing bonds as recommended
by the City Engineer.

SETTING OF SURVEY MONUMENTS AND RECOMMENDATION TO
RELEASE SECURITY
FOR CENTEX HOMES TRACT NO. 15797
I, Douglas A. Dancs, City Engineer for the City of Seal Beach, do herby certify that all of
the subdivision public improvements and survey monuments related to Centex Homes
Tract No. 15797, City of Seal Beach, State of California, which Tract No. 15797 is
located on the easterly side of Seal Beach Boulevard at Plymouth Drive/Rossmoor Center
Way, have been completed in a satisfactory manor.
I therefore recommend that all of the subdivision public improvements related to Centex
Homes Tract No. 15797 in the City of Seal Beach, State of California, be accepted by the
City of Seal Beach and that the following bonds posted with the City of Seal Beach
securing the installation of said public improvements and survey monuments and related
work be exonerated and released:
1. Faithful Performance Bond No. 6111100 in the amount of $936,786.85 provided
by Safeco Insurance Company of America.
2. Monument Bond No. 6111102 in the amount of $17,500.00 provided by Safeco
Insurance Company of America.
I additionally recommend that the following bonds, reduced as noted, remain in effect for
one (1) year from the date of approval of the Seal Beach City Council Resolution
Accepting Public Improvements and Authorizing Release of Security for Centex Homes
Tract No. 15797 in the City of Seal Beach, State of California, in order to provide for
repair of defective work and to provide security for labor and material claims that may be
filed against the City of Seal Beach and recommend that said following bonds, at the end
of the one (1) year period, be automatically exonerated and released at that time unless
during which time the City Council of the City of Seal Beach by resolution modifies such
exoneration and release:
1. Labor and Materials Bond No. 6111100 in the amount of $936,786.85 provided
by Safeco Insurance Company of America, reduced to $450,000.00.
2. Warranty Bond No. 6111101 in the full original amount of $23,419.71 provided
by Safeco Insurance Company of America.
