AYES: Blackman, Gray, Kredell, Laszlo, Weir NOES: None Motion carried Mayor Blackman expressed congratulations to Mr. and Mrs. Proctor Weir on their 49th wedding anniversary. PROCLAMATION Mayor Blackman proclaimed the month of March, 1978 as "Easter Seal Month." ORDINANCE NUMBER 1027 - PARKING - OVERSIZED and NON-MOTORIZED VEHICLES Ordinance Number 1027 was presented to Council for second reading by title "AN ORDINANCE OF THE CITY OF SEAL BEACH REGULATING THE OVERNIGHT PARKING OF OVERSIZED AND NON-MOTORIZED VEHICLES ON CITY STREETS, AND AMENDING THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA." By unanimous consent, full readinR of Ordinance Number 1027 was waived. Two m~mbers of the audience expressed their views in opposition to the ordinance. Mayor Blackman asked that the record show he voted in opposition to this ordinance at the January 23rd meeting. The Council discussed possible ! I I I 2-13-78 I locations for a recreational vehicle parking area. Mayor Blackman stated that he would support the ordinance with the suggestion that staff investigate a vehicle storage area and report back to Council before this ordinance is in effect. Gray moved, second by Weir, to adopt Ordinance Number 1027 as presented. AYES: Blackman, Gray, Kredell, Laszlo, Weir NOES: None Motion carried ORDINANCE NUMBER 1028 - ZONING - LOT COVERAGE - COLLEGE PARK EAST Ordinance Number 1028 was presented to Council for second reading by title "AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING SEC. 28-300(1) (e) AND SEC. 28-401(2)(a) OF CHAPTER 28, ZONING OF THE CODE OF THE CITY OF SEAL BEACH." By unanimous consent, full reading of Ordinance Number 1028 was waived. Blackman moved, second by Laszlo, to adopt Ordinance Number 1028 as presented. AYES: Blackman, Gray, Kredell, Laszlo, Weir NOES: None Motion carried ORDINANCE NUMBER 1029 - PURCHASING SYSTEM Ordinance Number 1029 was presented to Council by title "AN ORDINANCE OF THE CITY OF SEAL BEACH PROVIDING FOR THE PURCHASE AND SALE OF SUPPLIES, SERVICES AND EQUIPMENT." By unanimous consent, full reading of Ordinance Number 1029 was waived. The City Manager reported that the City Attorney had determined Section 3 of the ordinance to be in conflict with the City Charter and recommended that Section be revised to conform with the Charter and that the ordinance then receive first reading. Councilman Gray asked that Section 10 and Section 11 also be revised to reflect formal bidding procedures be followed for items of estimated value greater than $4,000 rather than the $5,000 as shown in the proposed ordinance. Gray moved, second by Laszlo, to approve the introduction of Ordinance Number 1029 with the recommended revisions to Section 3, Sections 10 and 11, and that the ordinance be passed to second reading. AYES: Blackman, Gray, Kredell, Laszlo, Weir NOES: None Motion carried ORDINANCE NUMBER 1030 - PARKLAND DEDICATION - SUBDIVISIONS Ordinance Number 1030 was presented to Council for first reading by title "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH I' I 2-13-78 ", -: AMENDING SECTION 21-12 OF CHAPTER 21 OF THE CITY CODE CONCERNING PARKLAND DEDICATIONS FOR SUBDIVISIONS. By unanimous consent, full reading of Ordinance Number 1030 was waived. The City Manager stated the proposed ordinance increased parkland dedication for subdivisions to five acres, provided for appraisal of land to determine in lieu I fees, and revised the household size to conform to the 1976 census. data. Kredell moved, second by Laszlo, to approve the introduction of Ordinance Number 1030 and that it be passed to second reading. AYES: Blackman, Gray, Kredell, Laszlo, Weir NOES: None Motion carried RESOLUTION NUMBER 2740 - NOTICE OF COMPLETION - DEMOLITION OF BUILDINGS - OLD CITY YARD SITE - PROJECT NO. 445A Resolution Number 2740 was presented to Council by title "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH DECLARING WORK TO BE COMPLETED AS TO PLANS AND SPECIFICATIONS FOR PROJECT NO. 445A, DEMOLITION OF BUILDINGS AT FORMER CITY YARD, IN ACCORDANCE WITH CONTRACT ENTERED INTO BETWEEN CHARLIE RAY GANN AND THE CITY OF SEAL BEACH." By Laszlo moved, second by Weir, to adopt Resolution Number 2740 as presented. 1 unanimous consent, full reading of Resolution Number 2740 was waived. By unanimous consent, full reading of Resolution Number 2741 was waived. Laszlo moved, second by Kredell, to adopt Resolution Number 2741 as presented. AYES: Blackman, Gray, Kredell, Laszlo, Weir NOES: None Motion carried RESOLUTION NUMBER 2742 - ELECTION OFFICERS and POLLING PLACES - MARCH 28, 1978 ELECTION I Resolution Number 2742 was presented to Council by title "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, NAMING THE ELECTION OFFICERS AND POLLING PLACES FOR THE PRIMARY MUNICIPAL ELECTION TO BE HELD IN THE CITY OF SEAL BEACH ON TUESDAY, 2-13-78 I the 28th DAY OF MARCH, 1978, FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AS REQUIRED BY THE CHARTER OF THE CITY OF SEAL BEACH, CALIFORNIA." By unanimous consent, full reading of Resolution Number 2742 was waived. Weir moved, second by Laszlo, to adopt Resolution Number 2742 as presented. AYES: Blackman, Gray, Kredell, Laszlo, Weir NOES: None Motion carried CONSENT CALENDAR Councilman Gray requested that Item "C" be removed from the Consent Calendar and the City Clerk requested that Item "A" be removed from the Consent Calendar. Blackman moved, second by Weir, to approve the recommended action for items on the Consent Calendar except Items "A" and "C" as presented. B. Approved regular demands numbered 26286 through 26501 in the amount of $246,374.99 and payroll demands numbered 25146 through 25368 in the amount of $115,306.34 as approved by the Finance Committee and that warrants be drawn on the Treasury for the same. D. Approved the plans and specifications for the resurfacing of the Shapell Park basketball court and authorized the City Manager to obtain bids for the project. E. Approved request from Police Officer Diane I I 2-13-78 -. Vasquez for a medical leave of absence to be granted immediately and to continue through April 1, 1978. AYES: 'Blackman, Gray, Kredell, Laszlo, Weir NOES: None Motion carried I Items Removed From The Consent Calendar ITEM "A" - APPROVAL OF MINUTES The City Clerk stated that the minutes of the January 23rd meeting would be corrected to show Mayor Blackman's vote on the first reading of Ordinance Number 1027 as a "no" vote as he had requested. Blackman moved, second by Laszlo, to approve the minutes of the regular meeting of January 23, 1978 as corrected and the minutes of the regular adjourned meeting of January 30, 1978 as presented. AYES: Blackman, Gray, Kredell, Laszlo, Weir NOES: None Motion carried ITEM "C" - AWARD OF BID - MARINA PARK TENNIS COURTS - PROJECT NO. 464 Bids were received and opened by the City Clerk on January 11, 1978 at 2:00 o'clock p.m. for Project No. 464, Construction of Marina Park I Tennis Courts, as follows: Pacific Tennis Courts, Inc. Granstrom Construction, Inc. Wakeham Construction Jordon Construction Corp. $ 31,620 36,686 46,400 49,249 Councilman Gray suggested that this project be delayed until after the June election when the outcome of the property tax reform measure would be known. The City Manager reported that total funding for this project was $45,778 with the city's share being $11,500 which has been budgeted for some time. The other members of the Council expressed their feelings regarding this project. Krede1l moved, second by Blackman, to award the contract to Pacific Tennis Courts, Inc. in the amount of $31,620, reject all other bids and authorize the City Manager to execute the contract for Project No. 464. I AYES: Blackman, Kredell, Laszlo, Weir NOES: Gray Motion carried UNDERGROUND UTILITY DISTRICTS Mr. Johnson, City Engineer presented a report regarding undergrounding of overhead utility lines, noting that the City of Seal Beach is 2-13-78 I allocated approxim~tely $60,000 per year from the South em California Edison Company for undergrounding and that the total city allocation is now about $210,000. Mr. Johnson stated that a Underground Utility Advisory Committee had been formed in 1971 to study undergrounding of Pacific Coast Highway and had recommended a five part project to accomplish same, of which four parts of that project have now been completed. Mr. Johnson recommended that the Underground Utility Advisory Committee be reactivated to review and recommend an updated project list for the entire undergrounding program. Discussion followed regarding areas to be considered for undergrounding and the possible cost to property owners. Kredell moved, second by Weir, to reactivate the Underground Utility Advisory Committee to study underground projects and prioritize them for consideration of the CounciL AYES: Blackman, Gray, Kredell, Laszlo, Weir NOES: None Motion carried REPORT - PIER DAMAGE Mr. Johnson, City Engineer, reported to the Council the damages to the municipal pier resulting from the recent storm and requested authorization to make repairs to the pier at an estimated cost of $21,000. The City Attorney stated that Section 1010 of the City Charter allows that the City Council may waive bidding requirements if the Council determined the repairs to be an emergency. RESOLUTION NUMBER 2743 - REPAIRS TO MUNICIPAL PIER Resolution Number 2743 was presented to the Council and read in full entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO REPAIR THE MUNICIPAL PIER AND DECLARING THE EMERGENCY THEREOF." Kredell moved, second by Laszlo, to adopt Resolution Number 2743 as presented. AYES: Blackman, Gray, Kredell, Laszlo, Weir NOES: None Motion carried COUNCIL REPORTS and REQUESTS The City Council discussed requesting State or County funds to assist in repair of damages caused by the recent storm. Mayor Blackman I I 2-13-78 ..; i . reported a ground erosion problem in the area of Crestview and Catalina Avenues and asked that those residents be informed of ways to control this erosion. In response to a que~tion from Mr. Laszlo, the City Engineer reported the number of downed city trees in parkways and private trees in streets were 155 in College Park East, 20 in College Park West and 60 in the hill and downtown areas. The Council commended the Public Works Department, the Fire Department ,and the Police Department for their work and clean up as a result of the recent storm. The City Engineer reported that the storm drain system worked well and that there was no problem with flooding. The Council discussed the beach sand erosion problem at length with the City Manager reporting that the Corps of Engineers study had been completed and that we should receive the report by September. Mr, Courtemarche noted that if the study showed the city's beaches are effected with an erosion problem, we could not expect to receive sand replenishment before October, 1978. It was clarified that the city would be replacing damaged trees on public property as quickly as personnel could accomplish this. ORAL COMMUNICATIONS Mayor Blackman declared oral communications open from the audience. Frank Yasius, College Park East Condominiums, stated that fifty to seventy-five trees were due to be removed from that area. The City Engineer was asked to investigate removing and transplanting those trees. Mr. Terry Barton, 415 Ocean Avenue, suggested a temporary committee to study repair and beautification of Eisenhower Park. The City Manager reported that a letter had been sent to the artist of the sand painting but that a response had not been received to date. There were no other oral communications; Mayor Blackman declared oral communications closed. The City Council recessed the meeting at 9:55 p.m. until after the close of the Redevelopment Agency meeting. The City Council reconvened at 10:53 p.m. with Mayor Blackman.calling the meeting to order.
