Director of Public Works /City Engineer SUBJECT: AUTHORIZATION OF WASTEWATER CONVEYANCE AGREEMENT (SUNSET AQUATIC PARK SEWER) WITH _ _ THE CITY OF HUNTINGTON BEACH SUMMARY OF REQUEST: The proposed City Council action will authorize the City Manager to execute a Wastewater Conveyance Agreement with the City of Huntington Beach for the conveyance of wastewater from the County of Oragne, Sunset Aquatic Park facility. BACKGROUND: Sunset Aquatic Park, a Regional Park operated and leased by the County of Orange is served Water and Wastewater by the City of Seal Beach. Pipes crossing under ,Ala s Bay and two "( Huntington Harbor serve the facility. On March 12, 2003 it was determined that the sewer force main pipe that sends wasterwater from the Park to the Seal Beach pump station at Seal Beach Blvd and Electric Ave. was leaking into the Bay. The water, sewer forcC main pipe and associated pump station were shut down. The City moved quickly to organize a temporary pumping situation, which allowed the water to be turned back on for the Park. The Department placed an above ground holding tank at the first pump station in the parking lot to temporarily collect the sewage on site. This tank is pumped into a truck and transported to a location where the waste will be deposited into the sewer system. This method is a temporary method and costs up to $3,000 a week until a permanent solution is completed to abate the nuisance. On its March 24, 2003 meeting, the City Council found that the situation was an emergency per City Charter Section 107, a matter of urgent necessity as used in Charter Section 1010, and a nuisance per City Code Sections 14 -1 and 14 -10 thereby authorizing emergency work. As a pro- active alternative the City has been working with the City of Huntington Beach over the past year to explore the possibility of Huntington Beach accepting the flows from Aquatic Park. New force mains would be installed and connected with the Huntington Beach's sewer system. This would mean that flows would be pumped in the opposite direction easterly within the street right of way of Edinger Avenue. This alternative would have the least potential adverse impact upon Agenda Item 2' the environment. Upon discovery of the leak, the City began immediate negotiations with the City of Huntington Beach to develop the attached agreement. Working with the City's utility design consultant, AKM Consulting Engineer, the City developed plans and specifications for the construction of the new pipeline. The City submitted and obtained an encroachment permit from Huntington Beach for immediate installation of the two 2" diameter pipes easterly from the Park along Edinger Avenue to the manhole located at the intersection of Edinger Avenue and Trinidad Avenue. The City also received an encroachment permit from Orange County Public Facilities and Resources Department to allow the sewer line to be installed over the Edinger Bridge. An emergency contract was awarded for the installation of the pipeline and the project has been completed. The design and construction of the new pump station is near design completion and an emergency contract will be awarded in June of 2003. With the lengthy delivery times for certain equipment, the new pump station is not expected to be in operation before the end of summer. However, AKM and Staff have devised a way that may allow for the temporary hook -up of the existing station to the new pipes. Staff is pursuing this temporary option and expects to have the temporary station operational by July. This would save the average $2,000 to $3,000 weekly cost of transporting the wastewater by truck. As part of the connection to the City of Huntington Beach's sewer system, the City is required to enter into an agreement defining the scope of the connection, the capacity rights given to the City, and establishing the annual maintenance, operation, and capital cost which the City will be required to pay. Staff has reviewed the agreement document and is in agreement with its conditions. The City Attorney's office has also reviewed the document and approved it to form. After Council approves the agreement, it will be sent to the City of Huntington Beach City Council for their concurrent approval. Staff is requesting that City Council authorize the City Manager to execute the agreement. If not executed, the City will have to continue to transport the wastewater by truck at a $2,000 to $3,000•weekly cost until another alternative can be found. FISCAL IMPACT: The annual cost to the City's Sewer Enterprise Fund is expected to cost $3,300 per year. Funds for this annual cost have been programmed into the annual operations and maintenance budget in the inter - governmental section of the Sewer Enterprise Fund. Once the project is complete, the City will conduct a cost of service rate study for the area since it only serves Sunset Aquatic Park. Rates for Sunset Aquatic Park would be raised accordingly upon Council approval. Alternatively, the County could choose to assume maintenance and operations of the system. RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute the Wastewater Conveyance Agreement with the City of Huntington Beach for the conveyance of wastewater from the County of Orange, Sunset Aquatic Park Facility.
