PROCLAMATIONS Mayor Laszlo proclaimed September I, 1978 as "Kiwanis Kid's Day.'.' I Mayor Laszlo proclaimed the week of September 17 through the 23rd, 1978 as "Leukemia Week.'.' Mayor Laszlo proclaimed the month of September as "United Way Month." APPOINTMENTS TO BOARDS and COMMISSIONS Environmental Quality Control Board. It was the consensus of the Council to hold over the appointments to the E.Q.C.B. for Districts Three and Five until later in the meeting. Parks and Recreation Commission. Kredell moved, second by Laszlo, to appoint Mr. Robert Flint, 133 - 6th Street, to the Parks and Recreation Commission from District One for the full term ending July 1981. AYES: Gray, Kredell, Laszlo, Seitz, Weir NOES: None Motion carried I Seal Beach Administration Building Authority Kredell moved, second by Laszlo, to reappoint Barbara Rountree, 1527 Marine Avenue, to the Seal Beach Administration Building Authority from District One for full term ending July 1982. AYES: Gray, Kredell, Laszlo, Seitz, Weir NOES: None Motion carried 8-28-78 r ~ Mayor Laszlo asked that his appointment be held over to next meeting. Commission on Goals - Huntington Beach High School District Councilman Seitz objected to the City making this appointment and moved to refer this matter to the Seal Beach School District for the appointment. Councilman 'Weir seconded the motion. The City Manager explained that the District had requested appointment of an interested citizen from this community to serve on the Commission. Discussion followed and the motion was withdrawn. It was the consensus of the Council that the City Manager be directed to contact the Huntington Beach' add Seal Beach School Districts to obtain additional information on the objectives of the Commission and input regarding the city making this appointment, and that this matter be reconsidered.at next meeting. Orange County Housing Authority It was the 6rder of the Chair with consent of the Council to post- pone the appointment to the Orange County Housing Authority and that the citizens be notified of this vacancy through the local newspapers and invited to make application for the appointment, Council to consider appointment at a later date. ORDINANCE NUMBER 1054 - ENVIRONMENTAL..QUALITY CONTROL BOARD Ordinance Number 1054 was presented for second reading by title "AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, A CHARTER CITY, AMENDING CHAPTER 7B OF THE CODE OF THE CITY OF SEAL'BEACH." By unanimous consent, full reading'of Ordinance Number 1054 was waived. COlDlcilman Gray requested that the ordinance be amended to include the statement "the minutes of each meeting shall be prepared by a secretary elected from a member of that Board and the minutes forwarded to the City Manager for distribution to the City COlDlcil." Discussion followed with members of the COlDlcil and the audience ex- pressing their views. Gray moved, second by Weir, to approve the introduction of Ordinance Number 1054 as amended and that it be passed to second reading. It was clarified that a staff member could attend meetings as needed when requested through the City Manager. I I I AYES: Gray, Laszlo, Seitz, Weir NOES: Krede II Motion carried ORDINANCE NUMBER 1055 - APPROPRIATING ADDITIONAL MONIES to CASH BASIS FUND I Ordinance Number 1055 was presented for second reading by title "AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, APPROPRIATING ADDITIONAL MONIES TO THE CASH BASIS FUND FROM THE UNENCUMBERED BALANCE OF THE GENERAL FUND, AND AMENDING THE SEAL BEACH MUNICIPAL CODE." By unanimous consent, full reading of Ordinance Number 1055 was waived. Gray moved, second by Weir, to adopt Ordinance Number 1055 as presented. AYES: Gray, Kredell, Laszlo, Weir NOES: Seitz Motion carried ORDINANCE NUMBER 1056 - COUNCIL MEETING DATES Ordinance Number 1056 was presented to Council for first reading by title "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, I CALIFORNIA, AMENDING THE CODE OF THE CITY OF SEAL BEACH, ARTICLE 1, SECTION 2-1, RELATING TO COUNCIL MEETING DATES, AND REPEALING ORDINANCE NUMBER 852." By unanimous consent, full reading of Ordinance Number 1056 was waived. The Council discussed changing the City Council meeting day and also that the meetings could be set for an earlier hour. The COlDlcil referred to conflicting meeting times of other agencies. The City Manager stated he would provide a list of those meeting times for the Council. It was the consensus of the Council to postpone action on this matter pending further study. ORDINANCE NUMBER 1057 - ANIMAL REGULATIONS. Ordinance Number 1057 was presented to Council for first reading entitled "AN ORDINANCE OF THE CITY OF SEAL BEACH RELATING TO I ANIMAL REGULATIONS AND AMENDING THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA. " By lDlanimous cons ent, full reading of Ordinance Number 1057 was waived. Police Chief Cibbarelli expressed concern with enforceability of several sections of the proposed ordinance. Section 3-2.3 of the ordinance was discussed with the Police Chief 8-28-78 { '. f . , 8-28-78 recommending the last sentence in paragraph two be deleted regarding 'removal of an animal without consent of its owner:' Gray moved, second by Weir, to approve Section 3-2.3 as written. AYES: Gray, Kredell, Laszlo, Seitz, Weir NOES: None Motion carried I Chief Cibbarelli expressed concern with Section 3-10.6 and the reference to 'lD1licensed' cats. Lengthy discussion followed with members of the audience speaking to the Section. Gray moved, second by Weir, to delete the word 'unlicensed' from Section 3-10.16. AYES: Gray, Kredell, Weir NOES: Laszlo, Seitz Motion carried Councilman Seitz requested that Section 3-2.1, Vicious Animals, be amended by deleting the words 'securely attached to a chain. I Gray moved, second by Weir, to approve the introduction of Ordinance Number 1057 as amended by motion and including the suggestion by Mr. Seitz, and that it be passed to second reading. AYES: Gray, Kredell, Seitz, Weir NOES: Las zlo Motion carried I It was noted that during a meeting between the Animal Control Committee and the City Attorney to finalize'this ordinance, the City Attorney had recommended that Sections 3-10.7 and 3-10.18 be deleted from the ordinance. Weir moved, second by Gray, to further amend Ordinance Number 1057 by deleting Sections 3-10.17 and 3-10.18 and that the remaining sections of the ordinance be renumbered accordingly. Resolution Number 2815 was presented to Council and read in full entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, I CALIFORNIA, HONORING GLENN R. WATSON, ESQ. FOR HIS COMMENDABLE SERVICE TO THE CITY OF SEAL BEACH AS CITY ATTORNEY." Weir moved, second by Gray, to adopt Resolution Number 2815 as presented. Kredell moved, second by Weir, to approve the recommended action for items on the Consent Calendar except Items "A", "D", "G" and "H" as presented. B. Approved regular demands numbered 28757 through 28906 in the amount of $125,760.94 and payroll demands numbered 28591 through 28860 in the amount . 8-28-78 r . of $149,812.88 as approved by the Finance Committee and that warrants be drawn on the Treasury for the same. C.. Established Monday, September 11, 1978 as the date to consider Tract Map 10428. E. Denied the claim of Ted Henkel for personal injury and referred same to the city's insurance carrier. F. Approved the attendance of Mr. Lopez, General Maintenance Foreman, at the Maintenance Superin- tendents Association of California Conference'and that $240,00 be authorized to attend the eonference. Gray, Kredell, Laszlo, Seitz, Weir I AYES: NOES:' None Motion carried Items Removed From the Consent Calendar ITEM "A" - APPROVAL OF MINUTES Mayor Laszlo stated he was absent from that meeting, therefore would abstain from voting on the approval of the minutes. Gray moved, second by Weir, to approve the minutes of the regular meeting of August 14, 1978 as presented. AYES: Gray, Kredell, Seitz, Weir NOES: None ABSTAIN: Laszlo Motion carried ITEM "D" - 12th ANNUAL SEAL BEACH JUNIOR HIGH SCHOOL BAND REVIEW Councilman Kredell asked if it was customary to honor members of the community at each Review. The City Manager responded that it was not, however, retiring Superintendant of Schools, Mr. Dressler was given that honor last year. Kredell moved, second by Weir, to approve the request to schedule the Twelfth Annual Seal Beach Junior High School Bank Review on November 11, 1978 at 11:00 a.m. AYES: Gray, Kredell, Laszlo, Seitz, Weir NOES: None Motion carried ITEM "G" - PUBLIC WORKS DEPARTMENT - MAINTENANCE WORKER I POSITION In response to a question from Mr. Gray, the City Manager explained that C.E.T.A. employees are given the opportunity to apply for any I I 8-28-78 r vacant positions. Gray moved, second by Kredell, to authorize the City Manager to fill the position of Maintenance Worker I in the Public Works Department. AYES: Gray, Kredel1 , Laszlo, Weir I NOES: Seitz Motion carried ITEM "H" - LIGHTING SYSTEM - MARINA PARK TENNIS COURT and BASKETBALL COURT - PROJECT NO. 464 The City Engineer explained the type of lighting element that was proposed for this project, in response to Mr. Krede11's question. Krede1l moved, second by Weir, to approve the plans and specifications for the lighting system for Marina Park tennis court and basketball court, and authorized the City Manager to advertise for bids. AYES: Kredell, Laszlo, Seitz, Weir NOES: Gray Motion carried PLANNING DIRECTOR POSITION The City Manager reported that at the request of the Council the Planning Commission had considered whether or not to retain the I position of Planning Director and had recommended that position be retained. Mr. Courtemarche requested authorization to continue recruitment for the position. COlDlcilman Seitz voiced opposition to filling the Planning Director position without review of the applicants by the Council. The City Attorney informed the COlDlcil that their involvement in the hiring process would be in conflict with the City Charter. Discussion followed. Gray moved, second by Weir, to authorize the City Manager to continue the recruitment process to fill the vacancy of Planning Director. AYES: Gray, Kredell, Laszlo, Weir NOES: Seitz Motion carried LEAGUE OF CALIFORNIA CITIES CONFERENCE - VOTING DELEGATE Gray moved, second by Weir, to designate Mayor Laszlo as the voting I. delegate for the City of Seal Beach at the League of California Cities Conference and that Mr. Gray be designated as the alternate voting delegate. REPORT - ORDINANCE NUMBER 1050 - ENVIRONMENTAL QUALITY CONTROL BOARD It was the consensus of the Council that no action be taken on Ordinance Number 1050, "AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, REPEALING CHAPTER 7B OF THE CITY CODE RELATING TO THE ENVIRONMENTAL QUALITY CONTROL BOARD." I Appointments - Environmental Quality Control Board It was the consensus of the Council that appointments to the Environmental Quality Control Board for Districts Three and Five be held over to next meeting. PLANNING COMMISSION RESOLUTION NO. ll60 - PARKING IN THE COASTAL DISTRICT Mr. Antos, Acting Planning Director, reported that the Planning Commission had discussed methods of improving parking in the Coastal District and had forwarded their suggestions to the Council within Resolution Number 1160, recommending that alleys be striped their legal width, that the Police Department cite all vehicles which encroach into the alley and cite all vehicles aprked across a public sidewalk. Members of the Council and the audience expressed their I views regarding the parking problem. Gray moved, second by Kredell, to direct the Public Works Department to prepare a survey and to stripe twenty blocks of vital alleys, that the Police Department patrol regularly and site for violations for the next sixty to ninty days as a pilot program and that COlDlcil reconsider this matter after that time. Discussion followed and the motion was withdrawn. It was the consensus of the Council:to allow a thirty day period for the Police Department to patrol the alleys without a surveyor striping of the alleys and issue citations for parking violations, as suggested by the Chief of Police and that the re- suits of the program be reported back to Council after the 30 day period. BUDGET REQUEST - POLICE I Chief Cibbarelli presented his report to Council requesting budget adjustments for the Police Department. Chief Cibbarel1i presented his justification for each request. Gray moved, second by Weir, to authorize the hiring of one full-time Parking Control Officer. 8-28-78 , 1 AYES: Gray, Kredell, Laszlo, Seitz, Weir NOES: None Motion carried Seitz moved, second by Laszlo, to authorize the filling of the current vacancy for the position of Police Officer. AYES: Gray, Kredell, Laszlo, Seitz, Weir' NOES: None Motion carried Gray moved, second by Weir, to authorize replacement of the $30,000 cut from the Police Department's Overtime Budget. AYES: Gray, Kredell, Laszlo, Weir NOES: Sei tz Motion carried There was no action taken by the Council to replace the Property/ Statistician Clerk at this time; Councilman Gray suggested that full review be prepared of the items that have been replaced in the 1978-79 fiscal year budget to date. VOLUNTEER FIRE DEPARTMENT - COMPENSATION 1 The City Manager presented information relating to the request by the Seal Beach Volunteer Fire Department for reinstatement of compensation, noting that the proposed budget figure was $11,520 and that the Council had cut the budget by $9,000 for the 1978-79 fiscal year. Robert O'Rear, Secretary/Treasurer of the VollDlteer Fire Department, addressed the Council, explaining the function of the Volunteer group and requested that the COlDlcil consider reinstating the compen- sation. Kredell moved, second by Weir, to reinstate the $9,000 cut from the 1978-79 fiscal year budget for the Volunteer Fire Department. COlDlcilman Seitz stated he was not in favor of changing the budget as adopted. COlDlcilman Gray reiterated his request for full budget analysis to this time will all budget adjustments defined. AYES: Gray, Kredell, Laszlo, Weir NOES: Seitz Motion carried COUNCIL REPORTS and REQUESTS Councilman Kredel1 asked if City personnel and equipment were being used for the bike trail construction. The City Engineer responded that the equipment was rented and the California Conservatfon Corps personnel were performing the work through an agreement between the I r 8-28-78 City and that agency. Mr. Johnson further stated that all costs for personnel and equipment would be reimbursed to the City by the State. Councilman Kredell asked for a report on sidewalk repair and an explanation of the options for payment of same. Mr. Kredell also asked when construction of the City Yard lots would begin. Mr. Johnson, I City Engineer, responded that the improvements to that subdivision would be presented for acceptance at next meeting:and that construction would begin when building permits have been obtained by the property _ owners. Mayor Laszlo requested a report of burglaries in the College Park East area. Councilman Weir reported that the Orange COlDlty MlDlicipal Water District would be holding a hearing regarding per acre increase in water prices; explained the flDlction of the Vector Control District and stated he felt the public should be made aware of this agency and its scope of responsibility; and reported on dis- cuss ion of transfer station weekend operations as discussed at the Solid Waste Management Technical AdvisorY Committee. The City Manager reported to COlDlcilman Seitz that his request for road button and a . traffic signal at McGaugh School had been referred to the city's I Traffic Safety Committee, and would be considered in the near future. ORAL COMMUNICATIONS Mayor Laszlo declared oral communications open from the audience. Gordon Shanks, 215 Surf Place, expressed concern regarding the Affirmative Action Plan as it related to the Police Department. Jeff Aberbach, Seal Beach Journal City Editor, stated he would be leaving the Journal and the City to accept new employment. Lew Bennett, 403 Ocean Avenue, complained about city'trimming of trees in parkway areas. Michelle Bennett, 403 Ocean Avenue, also spoke regarding tree trimming. The City Engineer clariffed that the city does plant trees in public parkway areas and that parkway trees are trimmed for safety further stated that it is illegal to plant trees in public parkways I to pedestrian traffic and for street sweeping purposes. Mr. Johnson ,without the permission of the city. Council discussed personal contact with the 'property owner prior to trimming of parkway trees. Ron Adams, Fire Chief, expressed appreciation to the Council for the reinstatement of Volunteer Fire Department compensation. Adah Winters, 1507 Electric 8-28-78 / 9-11-78 r Avenue, read a letter from the ~nima1 Control Committee regarding elimination of skunks. There were no other oral cOmmlDlications; Mayor Laszlo declared oral communications closed.
