Ingram, Acting City Manager FROM: Mark Persico, AICP, Director of Development Services SUBJECT: REVIEW PROCESS FOR THE PROPOSED DWP SPECIFIC PLAN AMENDMENT SUMMARY OF REQUEST: That the City Council receives and files the report. BACKGROUND AND ANALYSIS: The City Council recently settled the litigation related to the eminent domain action on the property known as "DWP" and the improvements to the River's End Staging Area parking lot and bike trail. The parties are now ready to move forward with the review of the proposed development project. The settlement agreement did not commit the City to any project, nor did it reduce the City's ability to impose environmental mitigation measures as part of the Environmental Impact Report (EIR) process. The agreement does require the City to review the project in a fair and timely manner. On August 9, 2010, the City Council approved a reimbursement agreement between Bay City Partners (BCP) and the City. Concurrently, the City Council approved a contract with RBF Consulting for preparation of the EIR whereby BCP would pay for the cost of preparing the EIR. Staff has worked with RBF Consulting to prepare a flow chart, attachment A, outlining the sequence of events and the roles and responsibilities for each group involved in the DWP Specific Plan amendment review process. In the DWP Specific Plan, the role of the DWP Advisory Committee is fairly vague. In summary, the Plan states the Committee shall provide citizen input and review all matters relating to the DWP Specific Plan. The attached flow chart further defines the role of the DWP Advisory Committee. Agenda Item H • �Y Page 2 FISCAL IMPACT: No impact at this time.
