SUBJECT: MUNICIPAL CODE REVISION RELATING TO
WHEELED DEVICES ON SIDEWALKS
SUMMARY OF REQUEST:
Introduce Ordinance No. 1608, An Ordinance of the City of Seal Beach
Amending Section 8.05.040 of the Seal Beach Municipal Code Relating to
Wheeled Devices on Public and Private Property and direct staff to schedule for
second reading and adoption at next regular City Council meeting.
BACKGROUND:
After a recent complaint of skateboarders disturbing the peace, City Staff
determined that the current provisions of the Municipal Code concerning
"wheeled devices" required clarification. The proposed amendment will clarify
that the riding or operating wheeled devices are prohibited in the following
locations:
• City sidewalks
• Public property other than sidewalks where signs prohibiting such
activity are posted.
• Pedestrian walkways in privately owned shopping centers where
signs prohibiting such activity are posted.
The Code defines a "wheeled device" to include bicycles, roller skates, scooters,
segways, and skateboards. It specifically excludes baby strollers; shopping
carts, wheelchairs; and motorized cycles utilized by disabled persons. No
changes are proposed to this definition.
FISCAL IMPACT:
The fiscal impact of the proposed amendment, if any, would be minor.

ANALYSIS:
The proposed amendment has been reviewed and approved as to form by the
City Attorney.
RECOMMENDATION:
Introduce Ordinance No. 1608, An Ordinance of the City of Seal Beach

Wheeled Devices on Public and Private Property and direct staff to schedule for
second reading and adoption at next regular City Council meeting.

ORDINANCE NUMBER 1608
AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING
SECTION 8.05.040 OF THE SEAL BEACH MUNICIPAL CODE
RELATING TO WHEELED DEVICES ON PUBLIC AND PRIVATE
PROPERTY
THE SEAL BEACH CITY COUNCIL DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Section 8.05.040 of the Seal Beach Municipal Code is
amended to read as follows:
§ 8.05.040 Wheeled Devices Prohibition
A. Wheeled Device: For the purpose of this section, a "wheeled
device is any wheeled device propelled by human or mechanical
power. "Wheeled device" includes without limitation: bicycles, roller
skates, scooters, segways, and skateboards. "Wheeled devices"
does not include: cars, trucks and equivalent vehicles; baby
strollers; shopping carts utilized for transportation of goods;
wheelchairs; and motorized tricycles and motorized quadricycles
utilized by persons otherwise unable to move about as pedestrians
by reason of physical disability.
B. Prohibition: No person shall ride or operate a wheeled device in
any of the following locations:
1. City sidewalks
2. Public property other than sidewalks where signs
prohibiting such activity are conspicuously posted.
3. Privately owned sidewalks used for pedestrian traffic
where signs prohibiting such activity are conspicuously posted.

Beach at a regular meeting held on the day of , 2011.
