HomeMy WebLinkAboutAGMT - California Public Employee Retirement System (CalPERS) Contract f I.._ Ca1PERS California Public Employees' Retirement System AMENDMENT TO CONTRACT Between the Board of Administration California Public Employees' Retirement System and the City Council City of Seal Beach The Board of Administration, California Public Employees' Retirement System, hereinafter referred to as Board, and the governing body of the above public agency, hereinafter referred to as Public Agency, having entered into a contract effective June 1, 1958, and witnessed April 28, 1958, and as amended effective August 1, 1968, July 1, 1972, May 16, 1973, October 12, 1977, July 4, 1979, August 13, 1980, September 17, 1986, July 22, 1987, July 11, 1991, September 23, 1994, December 15, 1995, July 10, 1997, May 21, 2003 and November 19, 2003 which provides for participation of Public Agency in said System, Board and Public Agency hereby agree as follows: A. Paragraphs 1 through 13 are hereby stricken from said contract as executed effective November 19, 2003, and hereby replaced by the following paragraphs numbered 1 through 13 inclusive: 1. All words and terms used herein which are defined in the Public Employees' Retirement Law shall have the meaning as defined therein unless otherwise specifically provided. "Normal retirement age" shall mean age 55 for local miscellaneous members and age 50 for local safety members. 2. Public Agency shall participate in the Public Employees' Retirement System from and after June 1, 1958 making its employees as hereinafter provided, members of said System subject to all provisions of the Public Employees' Retirement Law except such as apply only on election of a contracting agency and are not provided for herein and to all amendments to said Law hereafter enacted except those, which by express provisions thereof, apply only on the election of a contracting agency. ,1 • • • 3. Employees of Public Agency in the following classes shall become members of said Retirement System except such in each such class as are excluded by law or this agreement: a. Local Fire Fighters (herein referred to as local safety members); b. Local Police Officers (herein referred to as local safety members); c. Ocean Beach Lifeguards (included as local safety members); d. Employees other than local safety members (herein referred to as local miscellaneous members). 4. In addition to the classes of employees excluded from membership by said Retirement Law, the following classes of employees shall not become members of said Retirement System: a. PERSONS COMPENSATED ON AN HOURLY BASIS HIRED AUGUST 1, 1968 OR AFTER. 5. The percentage of final compensation to be provided for each year of credited prior and current service for local miscellaneous members shall be determined in accordance with Section 21354 of said Retirement Law, subject to the reduction provided therein for service prior to June 30, 1972, termination of Social Security, for members whose service has been included in Federal Social Security (2% at age 55 Full and Modified). 6. The percentage of final compensation to be provided for each year of credited prior and current service as a local fire member shall be determined in accordance with Section 21362 of said Retirement Law (2% at age 50 Full). 7. The percentage of final compensation to be provided for each year of credited prior and current service as a local police member and an ocean beach lifeguard member shall be determined in accordance with Section 21362.2 of said Retirement Law (3% at age 50 Full). 8. Public Agency elected and elects to be subject to the following optional provisions: a. Section 21571 (Basic Level of 1959 Survivor Benefits) for local fire members only. b. Sections 21624, 21626 and 21628 (Post- Retirement Survivor Allowance). c. Section 21222.1 (One -Time 5% Increase - 1970). Legislation repealed said Section effective January 1, 1980. • 1 d. Section 20042 (One -Year Final Compensation). e. Section 20965 (Credit for Unused Sick Leave) for local miscellaneous members, local police members and ocean beach lifeguards only. f. Section 21024 (Military Service Credit as Public Service), Statutes of 1976. g. Section 20421 ( "Local Safety Member" shall include ocean beach lifeguards of a city as described in Government Code Section 20421). h. Section 21573 (Third Level of 1959 Survivor Benefits) for local miscellaneous members, local police members and ocean beach lifeguards only. i. Section 20903 (Two Years Additional Service Credit) for local miscellaneous members only. 9. Public Agency, in accordance with Government Code Section 20790, ceased to be an "employer" for purposes of Section 20834 effective on October 12, 1977. Accumulated contributions of Public Agency shall be fixed and determined as provided in Government Code Section 20834, and accumulated contributions thereafter shall be held by the Board as provided in Government Code Section 20834. 10. Public Agency shall contribute to said Retirement System the contributions determined by actuarial valuations of prior and future service liability with respect to local miscellaneous members and local safety members of said Retirement System. 11. Public Agency shall also contribute to said Retirement System as follows: a. Contributions required per covered member on account of the 1959 Survivor Benefits provided under Section 21573 of said Retirement Law. (Subject to annual change.) In addition, all assets and liabilities of Public Agency and its employees shall be pooled in a single account, based on term insurance rates, for survivors of all local miscellaneous members, local police members and ocean beach lifeguards. b. A reasonable amount, as fixed by the Board, payable in one installment within 60 days of date of contract to cover the costs of administering said System as it affects the employees of Public Agency, not including the costs of special valuations or of the periodic investigation and valuations required by law. • • • c. A reasonable amount, as fixed by the Board, payable in one installment as the occasions arise, to cover the costs of special valuations on account of employees of Public Agency, and costs of the periodic investigation and valuations required by law. 12. Contributions required of Public Agency and its employees shall be subject to adjustment by Board on account of amendments to the Public Employees' Retirement Law, and on account of the experience under the Retirement System as determined by the periodic investigation and valuation required by said Retirement Law. 13. Contributions required of Public Agency and its employees shall be paid by Public Agency to the Retirement System within fifteen days after the end of the period to which said contributions refer or as may be prescribed by Board regulation. If more or less than the correct amount of contributions is paid for any period, proper adjustment shall be made in connection with subsequent remittances. Adjustments on account of errors in contributions required of any employee may be made by direct payments between the employee and the Board. B. The sample Ordinance is a guide only and is included to allow sufficient time to prepare the Ordinance for a first and final reading. The Resolution of Intention and accompanying documents should not be held pending final reading of the Ordinance. Government Code Section 7507 requires that the future annual costs of the proposed contract amendment be made public at a public meeting at least two weeks prior to the adoption of the final Ordinance. The agency is to certify compliance on the enclosed Certification of Compliance with Government Code Section 7507. The employer cost for the Third Level of 1959 Survivor Benefits is $1.50 per month per covered member. Agencies are billed annually and payments may vary depending on the funding reserve level. In addition, members covered by the 1959 Survivor Benefits contribute $2.00 per month. The agreement will acknowledge that public agencies subject to Section 21573 will have all assets and liabilities pooled into a single account based on term insurance rates, for local miscellaneous members and ocean beach lifeguards. In summary, the following documents must be returned to this office before we can forward the actual contracts and other final documents necessary to complete the proposed contract. DO NOT HOLD THESE DOCUMENTS PENDING ADOPTION OF THE FINAL ORDINANCE. ORIGINAL SIGNATURES ARE REQUIRED 1. Resolution of Intention, original or certified copy. 2. If your agency adopts the Resolution of Intention on April 14, 1997, the earliest date the final Ordinance may be adopted is May 4, 1997. There must be a 20 day period between the adoption of the Resolution of Intention and the adoption of the final Ordinance, pursuant to Government Code Section 20471. Till, City Manager SUBJECT: Amendment - Public Employees' Retirement Contract SUMMARY OF REQUEST: That City Council approve an amendment to the Public Employee's Retirement Contract by adoption of attached resolution and introduce first reading of attached ordinance. BACKGROUND: The City of Seal Beach contracts with the California Public Employees' Retirement System to provide retirement benefits for its employees. The 1959 Survivor Benefit is available to City of Seal Beach PERS members who are not covered by Social Security and was originally structured to provide a monthly benefit to the families of employees who die prior to retirement. The City of Seal Beach currently has Level 1 1959 Survivor Benefit for its non -sworn full -time employees. Sworn safety employees received the higher level of benefit in July of 1991. As Social Security benefit levels have increased over the years, additional levels have been added to the PERS 1959 Survivor Benefits program. Legislation creating higher level of benefits established a risk pool consisting of all local public agency employers who elect to provide that level of benefit. This rate is based on the pooled experience of the entire participating group at each level rather than solely on each individual employer's experience which is used to determine the cost for Level 1 and Level 2 benefits. To change to a higher level of benefit, an amendment to the PERS contract is necessary. The employee cost would be $2.00 per month, the same amount that is paid for the current Level 1 benefit. P` Ti i .liztV.d iimSEA, . ,1<sk 4 tea' p ; • CITY OF SEAL BEACH CERTIFICATION/AGREEMENT DOCUMENT GOVERNMENT CODE SECTION 20821.6 4-Year Additional Service Credit w/California Public Employees' Retirement System The City of Seal Beach certifies the following: On July 10, 1995, the City Council of the City of Seal Beach adopted attached Resolution 4394, granting 4-years service credit to certain employees. The costs of providing such service was made public two weeks prior to adoption of Resolution 4394. The position of Water Superintendent in the miscellaneous category, Public Works Department, is eligible for the 4-year additional service credit. By elimination of this position, the savings will exceed the cost of payment to PERS for providing the service credit. The position of Water Superintendent will remain vacant for at least 5 years to assure the savings will exceed the payments to PERS and until the lump-sum actuarial cost of the additional service credit granted has been recaptured from position vacancy salary savings. The amount of actual savings and the measures taken to achieve the savings are more than adequate to meet necessary payments to the board. The total costs were made public two weeks prior to adoption of the Resolution • granting the additional service credit in compliance with Government Code Section 7507. The City of Seal Beach agrees to transmit to PERS an amount determined by the Board to equal the actuarial equivalent of the difference between the allowance the member receives after receipt of the additional service credit and the amount the member would have received without the additional service credit plus administrative costs. The City of Seal Beach agrees to maintain records for each worker retiring pursuant to this section (name, social security number, retirement effective date and cost of additional service credit) and to provide verification of its certifications through independent review if the board so requires. The City of Seal Beach certifies that the eligible employee will not receive unemployment insurance payments anytime within two years of the Council's adoption of the Resolution granting additional service due to employment with any employer participating in the PERS retirement program. The City of Seal Beach also certifies the amount of actual savings and the measures taken to achieve the savings at such time the governing body has achieved savings that are more than adequate to meet necessary payments to the Board or five years after commencement of the 120 day period or whichever occurs first. • • • AMENDMENT TO CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY COUNCIL OF THE CITY OF SEAL BEACH The Board of Administration, Public Employees' Retirement System, hereinafter referred to as Board, and the governing body of above public agency, hereinafter referred to as Public Agency, having entered into a contract effective June 1, 1958, and witnessed April 28, 1958, and as amended effective August 1, 1968, July 1, 1972, May 16, 1973, October 12, 1977, July 4, 1979, August 13, 1980, September 17, 1986, July 22, 1987 and July 11, 1991, which provides for participation of Public Agency in said System, Board and Public Agency hereby agree as follows: A. "Normal retirement age" shall mean age 60 for local miscellaneous members and age 50 for local safety members. 2. Public Agency shall participate in the Public Employees' Retirement System from and after June 1, 1958 making its employees as hereinafter provided, members of said System subject to all provisions of the Public Employees' Retirement Law except such as apply only on election of a contracting agency and are not provided for herein and to all amendments to said Law hereafter enacted except those, which by express provisions thereof, apply only on the election of a contracting agency. 3. Employees of Public Agency in the following classes shall become members of said Retirement System except such in each such class as are excludes: by law or this agreement: a. Background The City of Seal Beach is currently operating under a three year Memorandum of Understanding (MOU) with the Seal Beach Police Officer's Association (copy attached), which will expire in June 1980. Section 5 of the MOU specifies that effective June 30, 1979, the 2% at 50 PERS Retirement Plan with Military Buyback and Survivor's Benefits be implemented. The 2% at 50 formula is an accelerated retirement program that was originally initiated for the California Highway Patrol. Since then, numerous cities have amended their retirement program for police and fire employees to the CHP plan. The city's current retirement program for police officers is the 2% at age 55 retirement plan. The primary distinction between the plans is that the CHP plan provides an earlier minimum age retirement with a higher pay back formula. Costs of the 2% at 50 Retirement Formula The amended retirement plan will increase the City's contribution rate 6.490% from the present 19.123% to 25.613 %. The contribution rate is the City's donation to each employee's retirement on a monthly basis. Police employees will continue to donate 7% toward their retirement. Total costs for the new program will be $506,959 per year effective July 1, 1979. This represents an increase of $160,900 (46.5 %) over 1978 -79 retire- ment costs for safety members from last year's cost of $346,059. Process for Amending Retirement Plan PERS requires that the City Council approve the Resolution of Intention prior to amending the PERS contract. In addition, the City must make public the cost figures explaining the increased retirement expenditure as illustrated previously to the general public for a period of two weeks. AGENDA ITEM # VI. Public Agency, in accordance with Section 20740, Government Code, ceased to be an "employer" for purposes of Chapter 6 of the Public • Employees' Retirement Law effective on October 12, 1977. Accumulated contributions of Public Agency as of the aforementioned date shall be fixed and determined as provided in Section 20759, Government Code, and accumulated contributions as of the aforementioned date and contributions thereafter made shall be held by the Board as provided in Section 20759, Government Code. 9. Public Agency shall contribute to said Retirement System as follows: a. Both parties understand that said Board of Administration will make available to the parties of the second part various tables and schedules of rates based on the experience under said Retirement System among members thereof, as determined in previous investigations and valuations. Both parties likewise understand that in accordance with said Retirement Law, the work to be performed by the parties of the second part shall be performed under the direction of the actuary of the Retirement System, and that all data in connection with said work including work sheets, final results, and reports from said parties of the second part, shall be the property of the Board of Administration and shall be delivered to said Board at the conclusion of said work. 5. For the full performance and completion of said services, the parties of the second part shall receive from the party of the first part, the sum of 246.50 subject to adjustment on account of variation in the number of employees wnose memberships are contemplated, and for when data are submitted as provided in para- graph L G hereof, from the number of such employees stated in paragraph 2, and sub- ject to any adjustment made on account of any unusual situation, or on account of further valuations of different combinations of benefits and contributions re- quested by the party of the first part, as nereinbefore provided.
