SUBJECT MAIN STREET ENCROACHMENT PERMIT POLICY
SUMMARY OF REQUEST
The proposed City Council action will adopt a Council Policy regarding issuance of
encroachment permits in the Main Street Specific Plan area
BACKGROUND
At the December 9, 2002 Council Meeting, a proposed encroachment policy on Main
Street was discussed with input from the public regarding the issue Attached are the
agenda staff report and the minutes from the meeting
To address the public comments, resolve the remaining issues and simplify the process,
the following changes to the policy are being proposed
• City Attorney's Office has provided a report regarding liability issues to Council
• It is proposed that the Public Works Department will inventory existing
encroachments on Main Street, inform property owners of the required corrective
action in accordance with the location standards, and if said actions are taken by
the property owner a no fee permit will be issued All new encroachments would
need to abide by the pohcy as adopted by Council The major benefit to this
approach is the reduction in effort required by existing businesses that have
placed encroachments For example, a property owner might need only to move
his/her bench over a few inches to gain compliance without going through the
formal application process
• It is proposed that location standard be modified so that the distance between the
benches shall be 5 feet wide but would not include an additional 2 feet in front of -
the bench (9 feet clear) This would allow benches to face each other while still
providing a 1 5 feet clear space from the back of the bench to the face of the curb
and a 5 feet distance between both benches

• It is proposed that the enforcement of the sign ordinance regarding temporary type
signs (sandwich boards) be held in abeyance until the appropriate sections of the
code (Zoning Code, Section 28 -1801, Sign Provisions Article 18, Prohibited
Signs 2 , (f)) are reviewed dunng the City's municipal code review process This
will separate the issues and allows the decision making process to move forward
since the intent behind regulations for signs versus allowing a bench are quite
different
• It is proposed that available news -rack locations be identified during the inventory
process mentioned above Once located, Council may review marked field
locations and a meeting with news -rack vendors can begin The news -rack
ordinance can be adopted as agreed upon dunng the Council study sessions on
municipal code revisions
• It is proposed that the Public Works Department install items such as bike racks,
trash cans or any other requested items from time to time by Council that will
replace those supplied by the property owners Staff wherever possible will notify
and work with affected business owners
• It is proposed that outdoor dining not be allowed as a new encroachment
FISCAL IMPACT
Proceeding with this policy and conducting an enforcement action regarding the existing
encroachments may result in allocation of staff and City Attorney resources not currently
allocated for these work tasks It is unknown at this time as to the amount of staff
resources that may be required to respond to the direction of the City Council Upon
direction being given by the City Council, staff will provide an estimate of the staff
allocations necessary to complete the desired action of the City Council
RECOMMENDATION
It is recommended that the City Council adopt a Council Policy regarding the
encroachments within the Main Street Specific Plan area

MAIN STREET ENCROACHMENT POLICY
The City Manager noted that some changes were made to the
Policy that staff would like to review with the Council
The Director of Public Works stated that the intent of this
item is to establish regulations for sidewalks on Main
Street a sidewalk is a place to walk place to gather and
the aesthetics of a downtown are determined by what trees
benches and planters are placed within them a minimum
sidewalk is generally about five feet wide Seal Beach has
twelve foot wide sidewalks which leaves seven feet to place
such amenities The reason for this Council has received
complaints from some residents and business owners relating
to the nature of what was taking place on Main Street
during the budget hearings staff was requested to look into
the concerns in August a draft policy was presented to
Council in October public outreach Questionnaires were
distributed to the businesses he and the City Manager
attended a Chamber of Commerce meeting and held an
additional meeting in November the responses received were
provided the attendees with the packet The Director said
one of the things that came forth from the November
meeting which is somewhat separate from the Main Street
Encroachment Policy was the temporary signs currently
there is an ordinance in place that does not allow the City
Engineer to issue permits for such signs staff received
verbal opposition as well as requests to cleanup the area
of the signs that leaves the Council a decision point to
either enforce the existing ordinance or to refer it back
to the Planning Commission to revise the ordinance that
exists He noted that some of the public comments received
have now been included in the Policy The Director
explained that initially a rental charge was proposed that
was looked at as a self - enforcing mechanism currently
there is a rental charge for such things as dumpsters in
the public right -of -way of about $1 per day there were a
number of public comments against a rental charge
therefore the recommendation is that there be no rental
charge and instead that an application and inspection fee
be adopted the intent is to bring the application and
inspection fee to Council in January as well as possibly an
after- the -fact grandfather clause at no cost for what
currently exists then for any new encroachments charge the
application /inspection fee Another point is that there
was no desire to stanaardlze aesthetics there was no real
consensus as to how things should look some people want
standardization some do not there were comments as to the
unique character of the town staff is currently
recommending that there not be standardized aesthetics
otherwise staff will become somewhat of a defacto art
source therefore if the encroachments tihether it be a
bench planter or whatever meet the location standards
they would be approved through the encroachment permit
process Another issue is the temporary encroachments
initially they were proposed to be handled under a special

activity permit similar to a sidewalk sale permit the
special event policy allowed up to six events in any given
year and that would be the recommendation of staff for
temporary encroachments As to outdoor dining the public
response was evenly split, that would be allowed only if
directed to draft a separate ordinance for that
encroachment with a recommendation for a public hearing
The Director noted that the last and most basic issue that
staff is desirous of instituting is location standards
sidewalks are basically a five foot walk zone Main Street
sidewalks are twelve feet so five feet should be free for
pedestrians to walk through also allow an aisleway for a
car that allotis a person exit their car without walking to
the back of another car and enter upon the sidewalk a
clear distance from infrastructure light poles trees
etc is also wanted ingress and egress from buildings was
looked at to assure that they are clear and meet the UBC
the height of encroachments was looked at as well an
example would be the hanging of a flag or other item from a
building in that case there would need to be enough
clearance to do so about eight feet
Councilmember Campbell made reference to page three of the
staff report item 3, relating to temporary
encroachments not to exceed more than six times per any
calendar year to which she asked if that meant six times
on an individual basis, not events designated by the City
staff responded in the affirmative With regard to item 2
standardization of aesthetics Councilmember Campbell asked
if there would be any type of benchmark The Public Works
Director referred to pictures at the end of the staff
report of basic standard benches as well as the wrap- around
benches mentioned during a prior meeting benches come in a
number of styles the intent is to not stifle creativity,
as an example one restaurant has cantilevered benches,
those would not fit into any standard that the staff would
suggest yet they would not be encroachments that would not
be allowed there could also be a wood bench with iron
railings there could be concrete benches there were
comments from the public that they did not want a Council
policy for certain things and did not want street furniture
to be cookie cutter The Director suggested that there
could be some criteria such as designate certain benches as
allowable then let people bring forth something of their
personal choice Councilman Antos noted that the Public
Works Department and the Planning Department have been
working on the newsrack issue, accoraing to information
provided in the past there woula be locations determined to
be acceptable, and inquired if staff will be doing the same
thing with this proposal look at Main Street and determine
the areas that would be generally acceptable for benches
etc as opposed to waiting until someone approaches the
City The response was that it was not the intention or
staff to designate locations along the Street there are
businesses that have already placed benches and there are
other businesses that have not expressed an interest in
having a bench but could Councilman Antos asked it
benches would be located in such a way that they would be
interspersed so that they do not become in effect outside

dining or where a business comes in and wants to put
benches on both sides of the walkway which again becomes
defacto dining The Director responded that it looks as if
with the twelve foot width of the sidewalks there could not
be two benches facing each other because they would need to
be eighteen inches from the curb face and in front of the
bench up to two feet of space would be needed then the
five feet of space would need to be maintained, however
there is nothing in the Policy that would prevent someone
from having three benches in a row provided they met the
five foot criteria Councilman Antos said whatever
criteria is adopted by the Council he tiould like to see
some maximum limitation on concentration of benches in any
area he would not like to see the ADD, area of walkway be
the only open area along the Street and when people park in
the stalls there is no way to access the vehicles The
Director said the standards could be adjusted the criteria
is for two feet on each side of the stalls to allow the
public ingress and egress from their vehicles therefore
benches could not be lined that woula block car access
there could be curbside bencnes provided the stalls were
not blocked or access from the parking space onto the
property Councilman Antos inquired if staff is looking
for a general Council policy as to what to do about things
that do not have permits such as the A -frame signs outside
displays etc , noted that there are existing policies and
ordinances that prohibit them, he would see no reason to
change that he could also see a problem with regulating
them if there were a proposal to change current Code from
his point of view he would support enforcing the current
ordinance requirements As a point of clarification with
regard to comments made during the Public Comment period
references were basically to sidewalk sale types of
activities Councilman Doane said rrom his reading he felt
it meant there would be a limit of six events per year
overall not an individual activity rather a planned
activity of the Chamber or someone else the objections he
heard seemed to be that some businesses are being conducted
that wa3, now and all of the time The Director of
Development Services confirmed that they are and there are
no permits for such activity what is being suggested is
that under a special activity permit an individual business
could make application up to six times a year Mayor
Larson offered that it seems there are three different Main
Streets there are the people that have been here for forty
years that think it looks one way what it looks like to
people walking the Street with fresh eyes, the third is
what it will be when an encroachment policy is adopted his
preference would be that it return to what it was forty
years ago a nice homey informal Street however with the
option that if the Street starts to look too sterile the
policies can be changed Councilman Antos agreed
Councilman Yost said he is somewhat torn on this issue he
has been contacted by people who are unhappy with the
current sidewalk sale atmosphere of the Street with card
tables etc on the other hand there are those who
compliment the town as a beautirul little place some of
the things that exist are chat gives the area its charm
some or the more tasteful 5 - frames for instance that draw

people to businesses that may be somewhat hidden to him
that adds to the homey feeling having the different styles
of benches adds to the same type of feeling it would be
nice if some of the current practices could be cleaned up
to some degree the card tables with merchandise as an
example is somewhat of a problem yet he would not be all
that anxious to change the atmosphere, possibly there is
some compromise his preference would be to keep Seal Beach
the way it is maybe some small changes and acknowledged
positively the statement that to make only two changes a
year would be fine Councilman Antos stated that there is
no way to control the A- frames and since there has
basically been a policy of ignoring them unless there is a
complaint the number of such signs have grown the Public
Works Director has indicated that the proposed policy would
be that if someone wants to have a flag a banner or sign
that is elevated about eight feet put it up in the
morning that would not obstruct people walking down the
sidewalk as it would be affixed to the building yet the A-
frames are there and continue to grow in number similar to
the newsracks Councilman Yost noted that it is said that
the economy is improving he has not seen that and he
would not want to put people out of business or make their
cost of doing business greater Councilman Doane expressed
his opposition to anything that takes away from the
merchants ability to do business yet with good taste
Councilman Antos moved to support the proposal of staff
with the option of reconsidering after a period of time if
the Street becomes sterile looking and direct staff to
enforce the ordinances relative to temporary structures
within the public right -of -way Mayor Larson seconded the
motion
Councilman Yost moved a substitute motion to continue this
issue for a period of two months Councilman Doane
seconded the motion
To the question of for what purpose the response of
Councilman Yost was to obtain more information learn more
about the proposals suggesting too a town hall meeting in
the Council Chambers for some resident input in addition to
the meeting that was held with the businesses to possibly
develop some compromises Councilman Doane expressed
belief that the Council is somewhat in agreement as to
benches etc possibly separate out the A -frame signs to
which there seems to be the most ob2ection Councilmember
Campbell noted that there are five issues tiith which people
seem to have concern and with a variety of opinions they
may need to be dealt tiith one by one Councilman Antos
stated that the only way he would vote to continue anything
relative to the A -frame signs is if a definitive report
kith court cases from the City Attorney as to the
liability of the City if those signs are allowed to remain
Mayor Larson noted that the two month period would put the
issue past the holiday season which would be important to
the businesses

The Mayor restated the substitute motion to hold this item
over for a period of two months The maker and second of
the motion accepted an amendment to direct the City
Attorney to prepare a report relative to potential
liabilities associated with A -frame signs etc

PUBLIC HEARING - APPEAL - CONDITIONAL USE PERMIT 02 -16/
HEIGHT VARIATION 02 -5 - 1210 ELECTRIC AVENUE - GHAZARIAN
Mayor Larson declared the public hearing open to consider
the appeal of Planning Commission approval of Conditional
Use Permit No 02 -16 and Height Variation 02 -5 relating to
1210 Electric Avenue The City Clerk certified that notice
of the public hearing had been advertised and mailed as
required by law reported receipt of two written
communications one gated November 10th another submitted
at this meeting copies or which were provided the Council
also noted that additional communications had been
presented directly to the individual members of the
Council
The Director of Development Services presented the staff
report this being an appeal of the Planning Commission
approval of a Conditional Use Permit for a major
addition /remodel of a nonconforming fourplex structure
located at 1210 Electric Avenue as well as an accompanying
Height Variation application to allow a covered roof access
stairway to the roof deck proposed for the second story
addition of the major expansion The Director reported
that the Planning Commission considered this matter under
public hearing on November 6th, after deliberations
determined to approve both the Conditional Use Permit and
the Height Variation on a four to one vote the Council
packet contains a copy of the appeal as well as the two
adopted Planning Commission Resolutions Commission stair
report minutes and letters submitted to the Commission
The Director noted that as part of the appeal there were a
number of issues raised to which staff has provided a
summary table of a brief overview of every minor plan
review or conditional use permit approved for expansion of
nonconforming residential structures between 1985 and the
present a second summary sets forth the various ordinances
adopted by the City from 1978 to current time the initial
ordinance shown is prior to the downzoning of the Old Ton
area to show what the pre\/ious aensities allowed goes
through all of the various aensity standards for the Old
Town area also the various amendments to the nonconforming
expansion provisions of the Code adopted between 1978 ana
current time The Director explained that the Planning
Commission approved the mayor expansion to the single story
unit located at 1210 Electric Avenue the house subject to
the proposed expansion was constructed in the mid -1960 s
in 1969 approvals were granted to construct the attached
three unit apartment complex and four garage spaces that
are provided on the property He noted that the provisions
of the Code relating to nonconforming expansions at this
time have two different processes that an applicant can

SUMMARY OF REQUEST
The proposed City Council action will adopt a Council Policy regarding issuance of
encroachment permits in the Main Street Specific Plan area
BACKGROUND
Seal Beach sidewalks within the Main Street Specific Plan Area are a desirable place to
walk, stroll and enjoy the downtown area Pedestrian related concerns are a prionty in
the creation of a successful downtown Tounsm, events, and daily business all create
pedestrian traffic Public sidewalks are to provide safe unobstructed passage whenever
possible but also allow streetscape amenities that enliven and support the public domain
There are numerous encroachments within the sidewalk area that have nevei been
officially permitted Some of these encroachments pose potential liability while otheis
enhance the experience of pedestrians and visitors to the downtown area This policy is a
natural progression for regulating all the encioachinents within a heavily traveled
pedestrian area
The following is a timeline of events regarding this issue
June /July 2002 Council requests policy regarding encroachments on Main

Council Policy Issues
Temporary Signs
Separate from the encroachment policy, at the November 2002 public meeting, many
attendees strongly voiced their dissatisfaction with direction received from Council to
enforce the current regulations of the sign code Article 18, Section 28 -1801, (f) prohibits
portable signs (i e sandwich board type signs) within the City both on private and public
property Many of these signs are within the public nght of way and m conflict with the
location standards that are set forth in the proposed policy
This issue is separate from the policy As it now stands, the City Engineer cannot legally
issue permits for tempoiary signs within the nght of way since this would be in violation
of the sign ordinance If Council desires that business owners be allowed to place signs
either on public, private, or both, the current ordinance must be changed
It is recommended after public input on this item that Council either assert their intent
that Staff enforce the existing ordinance or alternatively direct Staff to change the
existing sign ordinance If allowed by ordinance on public property, these signs would
need to be placed in accordance with the location standards promulgated by this policy
The encroachment policy would be changed at the time of adoption of a revised sign
ordinance
Main Street Enci oachment Policy
Staff received significant public comment regarding encroachments on Main Street The
following changes are recommended by staff to the draft policy
1 Do not charge an annual r ental charge but adopt an application and inspection
fee
2 Do not standai dine enci oachments aesthetics
3 Allow tempor aiy enci oachments (excluding signs) undei a special activity pei Writ
not to exceed moi e than six tunes pei any given calendai yeai
4 Once a City Council Ordinance has been established only allow outdooi dining
after a public hear ing
5 Only allow enci oachments that ai e in confoi mance with location standai ds
1 Do not charge an annual rental charge but adopt application and inspection fee
Onginally, Staffs intention for the rental charge was not to collect additional revenue but
rather let the rental charge act as a self - enforcing mechanism to allow for only those
encroachments that business owners strongly believed would be beneficial Additionally,
the City Engineer issues Temporary Street Obstruction Permits, "Dumpster Permits," for
use of the public right of way for up to 45 days The fees for this permit amount to about
a $1 per day of use and many cities charge on a square foot basis for use of the street

Additionally by not charging a rental charge, the City is allowing public space to be used
for private gain such as when outdoor dining is allowed
The public strongly voiced their opposition regarding this issue After le- evaluation, it is
recommended that a rental charge only be instituted if outdoor dining is allowed as an
allowable enci oachment
1 here will need to be a one -time application deposit to cover the cost of evaluating the
type of encroachment, whether its location is rn confonnance with the standards, and
processing the application Once the policy is adopted, a fee will be brought before
Council for approval in January 2003

From various public input received, there is no clear consensus from the public regarding
standardization of street furniture Many people voiced their opinions that standards
create the `Disneyland" approach and would ruin the small town atmosphere of the town
by reducing creativity Questions were raised would there be standards for every type of
encroachment such as planters, bike racks, and benches
Aesthetic standards work when there is a clear vision for an area Since this is not the
case, it is recommended that the vanous types of encroachments be allowed as long as
they can be placed within the location standards set forth by the City Engineer This will
prevent Staff from becoming a de -facto "design review board "

Since it would be difficult and costly to enforce any type of regular temporary
encroachment policy, encroachments that are of a temporary nature such as moveable
furniture, merchandise, tables, chairs, displays are proposed not to be allowed within the
public right of way unless otherwise allowed by ordinance or special event permit subject
to the location standards This allows business owners to still hold sidewalk sales and
event sales but leaves the sidewalk less cluttered Results from the questionnaire were
strongly in favor of allowing sidewalk sales under this type of regulation
The questionnaire revealed that people have differing ideas about how many tines these
events should occur Fourteen out of the eighteen respondents or 78% would not like to
see sidewalk sales held more than quarterly Attendees at the public meeting voiced their
opposition to this matter and that the current practice of daily merchandise should be
maintained
The current special activity permit policy allows for up to six events per any given
calendar year Since there is no consensus, it is recommended that this policy stay in
place for this type of event

From the questionnaire and public input there was no clear consensus on whether to
allow outdoor dining within the public nght of way Since this use would most likely
iequne a sepal ate oidinance and be approved after a public hearing, it should not be
allowed until such time directed by Council and would not be allowed under this policy

Since the sidewalk is only 12 feet wide and includes vanous existing fixtui es such as
trees, light poles, bus stops, hydrants, and newspaper racks the Engineenng Division has
developed location standards to ensure that proper clearances are met for pedestrian
travel, conformance with Amencan Disability Act requirements, and reduction of
liability These are identified in the attached Standard SB -140 -1 SIDEWALK
ENCROACHMENTS IN MAIN STREET SPECIFIC PLAN AREA
These include access aisle ways so people, including those in wheelchairs, can move
along the sidewalk freely, clearances so cars cannot hit or overtop encroachments, people
can access the sidewalk without walking in back of other cars, access for fire hydrants
and other public works improvements Aenal encroachments, except for signs, that
cantilever ovei the public nght of way such as flags aie allowed under this policy as long
as there is an 8 -foot cleaiance for pedestrians
Next Steps
If Council is interested in pursuing this issue further, the following schedule is proposed

The City Council of the City of Seal Beach met in regular
adjourned session at 6 30 p m with Mayor Larson calling
the meeting to order with the Salute to the Flag

COUNCIL STUDY SESSION
The Director of Public Works explained that what is being
presented is a proposed policy for Main Street
encroachments the Engineering Division is currently not
issuing permits foi encroachments into the public right -of-
way but there may have been permits in past years on a non -
regular basis, the intent is to create an area where there
can be encroachments yet allow for safe access for
pedestrians He noted that staff is looking at about eight
different issues, such as where wil the encroachments be
allowed, what type of encroachments will be allowed, how
much will be charged for the application, will the City
charge an appropriate rental fee for use of the public
right -of -way by the,private business, will temporary
encroachments be allowed, will the City use proactive Code
enforcement on encroachments such as temporary signs that
are currently in the right -of -way under existing City Code
outdoor dining, and catilever projections over the public
right -of -way The Director mentioned that this process
started with creating a location standard as a result of
going through the ADA access guidelines, talking with the
building official as to ingress and egress to buildings,
staff looked at everything possible that could be a
liability that in order to create a safe travel walkway
for pedestrians, an ADA walk zone is mentioned in the
standard which is about five feet wide, that is what ADA
calls for in order nor two wheelchairs to pass each other,
there is a twelve foot wine sidewalk therefore that leaves
approximately seven feet for encroachments on either side,
a three foot area remains open around a light pole fire
hydrant, any type of public works structure that is for
the purpose of maintenance etc a one and a half foot
area is proposed for the frontage of cars as there are no
bumper stops and it is important that the overhang of cars
not encroach over the csrb area where it could possibly
knock over a bench or other structure it is also desired
that pedestrians have the ability to exit their car in a
two foot area where the parking spaces intersect this

allows car passengers to leave the vehicle without walking
around the rear of the car He pointed out the ten foot
zone on each side of a crosswalk the reason for that is
that an 8 43 percent minimum slope is needed and minimum 2
percent crossfall yet still maintain the five foot
pedestrian isleway and landing area, with that information
in mind, it is felt that most of the Main Street
encroachments could be accommodated yet they would be
spread out more The Public Works Director mentioned that
staff was sent to Main Street to identify where the
encroachments exist, of which they took photographs,
examples were a bench not affixed to the public right -of-
way and in an area where a car could tip the bench over
benches need to be secured and an inability for a car to
tap any encroachment, there were free - standing tables and
signs, there are encroachments in and out of the five foot
walkway area, that is what needs to be regulated there are
benches facing each other in the same area that could be
resolved with some minimum relocation to keep the walkway
area open this could accommodate the number of benches vet
comply with the encroachment standards there should be a
three foot clear area around the trash receptacles also for
maintenance purposes With regard to temporary
encroachments, this has drawn a great deal of consideration
as to how they could be allowed, especially through the
Public Works Department, these would be things that would
not normally be allowed unless it is through an ordinance
or special event permit a sidewalk sale would be an
example otherwise it is difficult to enforce what is and
is not in the travel isleway, temporary chairs and tables
another example, another issue is use of the public right -
of -way for marketing purposes by the fronting business A
photo was shown of a small fence with flowers on the street
side fronting a business up to that point is public right -
of -way again there is the issue of ingress and egress
standards for ADA purposes for getting in and out of a
building, bike racks could be relocated somewhat to center
a parking space to allow the travel walkway for pedestrians
going in and out of their car also the five foot walkway,
bike racks chained to trees or too close to trees are not
wanted, they need to be appropriately placed in the right -
of -way Anothei photo depicted newsracks, sandwich board
signs, a display of products all in one area, under current
Code sandwich board signs are not allowed however are
enforced on a reactive basis, business products would not
be allowed to be displayed in the right -of -way without a
special event or activity permit the newsracks will be
addressed in a separate ordinance with regard to signs in
the right -of -way the question is whether the Council wants
staff to enforce the Code proactively Again with regard
to crosswalks benches that crowd that passageway, a
wheelchair pedestrian needs to have a clear landing area
benches could be moved somewhat to allow that much of this
could be accommodated if the location standards are
followed so that a safe travel walkway can be provided yet
still allow some of the streetscape improvements to remain
in the instance of a bench being chained to a light pole
staff would suggest that the bench merely be relocated
somewhat and affixed to the sidewalk, in some instances
things can be resolved by merely informing the property
owner of the standards With regard to outaoor dining, a

photo was shown of a small encroachment into the right -of-
way to this a direction from Council is sought if they
want to allow outdoor dining, if so staff would need to
investigate that further foi a policy With regard to the
types of encroachments staff is asking Council, within the
policy, for discretion to approve benches, bike racks,
kiosks tables, cans, yet for anything else staff would
want to bring it back to Council for review prior to
approval As to an application cost that would cover
application review to make certain the request meets the
standards staff also requests consideration of
establishing a rental license for use of the public right -
of -way, the range of costs in other cities have been found
to be between $1 and $3 per square foot for outdoor dining,
public meetings could be held with the business owners to
seek their input With regard to temporary encroachments
staff is proposing to not allow those unless allowed by a
special sidewalk permit Pioactive Code enforcement would
include the existing sandwich board signs, question is
should a code enforcement officer be directed to clear
those signs from the public right -of -way With regard to
outdoor dining, in the event a business were to come to the
City under the scenario that there is a twelve foot
sidewalk and they request to encroach by seven feet,
leaving a five foot area for pedestrian traffic, would that
use be allowed as to cantilever projections and overhangs,
staff is recommending that anything that currently exists
be grandfathered and any new requests would only be
required to pay the application fee but not the rental
charges associated with the use of walkable pedestrian
space Staff has also received requests to investigate
permitting encroachments in this aiea
Councilman Antos stated that the Main Street Specific Plan
calls for standardization of street furniture upon looking
at the photos shown one can see there is a variety of types
of bike lacks a variety of benches, including concrete
ones, it would seem that since the Main Street Specific
Plan has already been looked at in terms of newsracks, then
there should be an attempt to establish a standard for
benches bicycle racks, etc as well In regards to
newsracks it has already been pointed out that there are
places where they can and can not be located the City will
likely be purchasing them, that needs to be taken into
consideration before an application is made for a bench in
a specific location that may be in conflict As to the
temporary displays, tables chairs, signs Councilman Antos
stated he is not in favor of them it is known that there
are periodic sidewalk sales throughout the year and tied to
other activities that the City is involved in sponsoring,
businesses do put out displays in those instances for a day
or two then removed, he would not like to see temporary,
permanent displays A suggestion was made to him also that
in other cities that have trees on a main street such as
Seal Beach they have installed semi - circular benches around
the trees that would seem to be something that could
preclude the need for benches on either side of the
sidewalk walkway area

Councilman Larson inquired as to direction will the staff
be meeting with business people, will there be an ordinance
change or whatever The Public Works Director stated staff
would like to do a public outreach with the businesses,
meet and discuss their concerns, bring back a policy with
any Council suggestions, then formally adopt a policy it
would include where allowed, type allowed charges, feeling
on outdoor dining cantilever projections, also at this
time staff would request direction as to proactive Code
enforcement of the sandwich board signs now rather than on
a reactive basis To that there was an indicated
preference for proactive Code enforcement at this time by
Concilmembers Doane, Antos, and Yost Councilman Yost
offered that he has received comments from residents who
are not necessarily pleased with the temporary permanent
displays taking place on the sidewalks, that involves the
usage of the public right -of -way to expand the square
footage of a business, there is also the permanent
occupancy of the public space issue, an example are the
eves on the Watson building that eytend into the public
right -of -way, using public real estate permanently, or the
case of the railing that is on public property as well, a
use of taxpayers space for which they should be reimbursed
permanently, they are two different issues he would not
want to do damage to any business yet there should be a
uniform environment with the same rules for everyone
Councilman Doane spoke in support of the idea of circular
benches, possibly staff could be directed to look into the
cost of that, to that caution was raised as to the birds
that frequent the trees over which such benches would be
placed With regard to some standardization of benches,
the Director stated that if that is a direction of Council
he would bring back further information, and seek input
from the public and businesses during the public outreach
meetings in that there are a number of benches that
presently exist Councilman Yost made reference to certain
existing benches that are nice and charming yet not
everyone could afford that type, possibly there could be a
minimum standard, not necessarily a cookie cutter design up
and down the street
CLOSED SESSION
The City Attorney announced that pursuant to Government
Code Section 54956 9(b) and 54956 8, the Council would meet
in Closed Session to discuss one case anticipated
litigation, and to confer with the City s real property
negotiator relating to the one hundred acre deed restricted
Hellman Ranch Wetlands parcel The Council adjourned to
Closed Session at 6 50 p m and reconvened at 7 16 p m
The City Attorney reported the Council discussed the real
property issues pursuant to Government Code Section 54956 8
and that no reportable action was taken
PDJOURNMENT
It was the order of the Chair, with consent of the Council,
to adjourn the meeting at 7 17 p m

2 PURPOSE
This policy estabhshes regulations for the placement of encroachments under, on
or above public sidewalks in the Main Street Specific Plan Area This policy is
intended to promote the continued vitality of the downtown area by allowing
installation of street amenities in a manner that does not jeopardize pedestrians or
vehicular travelers
3 DEFINITIONS
For purposes of this policy the term "encroachment" means an inanimate object
located under, on or above a public sidewalk in the Main Street Specific Plan
Area and intended to be maintained in such location on a long -term basis
"Encroachment" includes without limitation the following awnings, banners,
benches, bike racks, kiosks, and trash receptacles
4 EXEMPTIONS
This policy does not apply to the following
4 1 Encroachments installed by a government entity or public utility
4 2 Temporary encroachments installed pursuant to a special event permit or
ordinance
4 3 Newsracks installed in accordance with the City's newsrack ordinance
5 ENCROACHMENT PERMIT
5 1 Requirement No person shall install an encroachment without first
obtaining, and maintaining in full force and effect, an encroachment permit for
such encroachment

5 2 Application Encroachment permit applications shall be submitted to the
City Engineer and shall consist of
5 2 1 A City - provided application form
5 2 2 A City - provided indemnification agreement The agreement shall
require the applicant to indemnify, defend (with counsel acceptable to
City) and hold harmless the City, its officers, employees and agents
against any and all claims, demands, losses, costs, expenses, obligations,
liabilities, damages, recovenes and deficiencies that the City shall incur or
suffer as a result of the applicant's encroachment Such obligation shall
include payment of interest, penalties and attorneys' fees
5 2 3 Written proof of liability insurance The insurance shall (i) be
issued by an insurer with a current A M Best's rating of A VII or better,
(11) name the City and its officers, employees and agents as additional
insureds, (iii) be primary and provide that any insurance maintained by the
City shall be excess insurance, (iv) indemnify for all liability for personal
and bodily injury, death and damage to property ansing from the
applicant's encroachment, and (v) provide a combined single limit liability
insurance of at least one million dollars per occurrence
5 2 4 A non - refundable application fee in an amount set by City Council
resolution
5 3 Field Inspection Each encroachment permit applicant shall participate in
a field inspection with the City Engineer The applicant shall mark, in chalk or an
equivalent method satisfactory to the City Engineer, the precise location proposed
for the encroachment The applicant shall remove the marking at the completion
of the field inspection
5 4 Public Notice The City Engineer shall send wntten notice of an
encroachment permit application to property owners and tenants having a legal
interest in property located within a 100 feet radius of the location proposed for
the encroachment The notice shall indicate that written comments in support or
protest of the application may be filed with the City Engineer within 7 days of the
date of the notice for consideration by the City Engineer
5 5 Approval or Denial By City Engineer If there are no grounds for denial,
the City Engineer may approve an encroachment permit application for the
following types of permanent encroachments benches, bike racks, kiosks,
tables, banners, decorative refuse receptacles The City Council may approve
encroachment permit applications for other types of encroachments if there are no
grounds for denial The following constitute grounds for denial of an
encroachment permit

5 5 1 Failure to complete the application
5 5 2 Knowing submission of a misleading or fraudulent statement of
matenal fact
5 5 3 Failure to comply with the location standards set forth in SB -140 -1

5 5 4 The proposed encroachment would be detrimental to the public
health, safety or welfare -
5 6 Term Each encroachment permit shall expire on the next June 30
following date of issuance unless it is forfeited for non -use or is revoked before
such date An encroachment permit shall automatically be forfeited for non -use
on the sixtieth day after issuance if the allowed encroachment has not been
installed Applications for renewal of an encroachment permit shall be processed
in accordance with the procedures governing initial applications Information that
is on file and unchanged need not be re- submitted with a renewal application
5 7 Revocation The City Engineer may summarily revoke an encroachment
permit and remove the allowed encroachment when necessary to eliminate an
immediate threat to the public health, safety or welfare Otherwise, the City
Engineer may revoke an encroachment permit following 5 days advance wntten
notice, and if requested by the permittee, a heanng The following shall constitute
grounds for non - summary revocation of an encroachment permit
5 7 1 Knowing submission of a misleading or fraudulent statement of
material fact
5 7 2 Failure to comply with the location standards set forth in SB -140 -1

5 7 3 Interference with a project to be undertaken by the City or a public
utility
5 8 Refunds Revocation of an encroachment permit shall not constitute
grounds for a refund of the encroachment permit fee unless the revocation is due
to interference with a project to be undertaken by the City or a public utility In
such situations, the refund amount shall be proportionate to the unexpired term of
the permit
5 9 Grandfather Rights Existing awning or marquee or overhang structure
encroachments shall be deemed to have received an encroachment permit as long

6 ENCROACHMENT LICENSE
6 1 Requirement An encroachment license shall be obtained concurrently
with an encroachment permit for each encroachment other than awnings
6 2 Term Each encroachment license shall expire concurrently with the
encroachment permit with which it is associated
7 ENFORCEMENT AUTHORITY
The City Engineer shall have junsdiction over encroachments and shall enforce
this policy

PUBLIC WORKS STANDARD
The following standards are applicable for sidewalk encroachments in the public right of way in the area designated in the
Main Street Specific Plan
General Requirements
Any type of sidewalk encroachment Including but not limited to street furniture structural or architectural elements of
adjacent improvements balconies stairways and overhangs bike racks tables public telephones kiosks vending
machines awnings banners private lighting systems walls or other type of outdoor enCi placed on sidewalk
within the public right of way shall comply with the following general requirements
• A minimum distance of not less than a five foot wide pedestrian travel aisle shall be maintained within the public
right of way at all times Areas with heavy pedestrian traffic may be required to maintain a minimum of eight feet
clear width on the sidewalk as determined by the City Engineer ,
• A minimum distance of not less than a two -foot wide pedestrian aisle shall be maintained on each side.of where the
parking stall line intersects the curb line to allow for adequate egress and Ingress of pedestrians from their vehicles
to the sidewalk area
• To ensure the required pedestrian travel aisle all encroachments shall Be set back a minimum of three feet from
any fixed sidewalk obstruction including but not limited to tree wells street trees parking meters water hydrants
light poles utility equipment boxes newspaper racks and bus benches
• Encroachments shall not be located within ten -feet of a cross walk
• All sidewalk encroachments shall comply with all applicable provisions of the Uniform Building Code including but
not limited to maintaining proper building egress and ingress at all times and providing appropriate handicap
access This includes for doorways that open in a r ens clear distance from the doorway for the width of the door
plus rne_OcL from the strike side of the door Jamb and for doorways that open out a ,E, : e clear distance from the
doorway for the width of the door plus r = - - 1 from the strike side of the door iamb
• Any encroachments which are cantileveredor hung above the sidewalk shall have a minimum of eight -foot
clearance from the ground to the lowest element of the encroachment to provide for adequate height clearance for
pedestrians
• Any encroachments within thirty rive reet rrom the intersection of street property lines shall not be in excess of two
and one halt feet high to provide ror adequate vision clearance ror vehicles
• Any encroachments within four feet from the intersection of an alley with any street right of way or at the
intersection of any alley with any other alley shall not be in excess of three feet high to provide for adequate vision
clearance for vehicles
• Encroachment shall be located at least one and a half feet rrom the curb face In areas where vehicles do not park
or otherwise extend over sidewalk this set back may be reduced at the discretion of the City Engineer
• Encroachments may not be chained or otherwise anchored to any tree street light parking meter or other property
Any application shall be denied if the City Engineer shall find that the maintenance of the encroachment would tend to
obstruct passage along any public way or create a hazard or would otherwise be detrimental to the public safety welfare or
convenience

Benches
When applying the above - mentioned general requirements to benches a two -feet allowance shall be made for the space
required for a person sitting on the bench
Benches to be Installed in an area where there is a theme or bench style shall conform to that theme or style
No bench shall be more than forty two Inches high nor more than two feet, six Inches wide nor more than seven reet long

Each bench must have displayed thereon in a conspicuous place the name of the permittee and the permit number

I am writing this because I will, unfortunately not be able to attend the City Council meeting on
November 18 Our gym, which serves the women of Seal Beach is located within the Seal Beach
Mall As such, it has little visibility from Main Street Yes, there is a business sign on the side of
the building but there is no way without individual display signs to let the passersby know of our
special promotional events or fitness packages This is extremely important to us as about 1/4 th of
all new members are walk -bys and after seeing the sign, come in and join There would be
significant financial hardships to the gym if these signs were not allowed and recommend m the
strongest possible manner that we not be made to get rid of them
