SUBJECT: REVISIONS TO PERSONNEL RULES
SUMMARY OF REQUEST:
That Council adopt the attached resolution approving revisions to the City's Personnel
Rules.
BACKGROUND:
As a result of the recent charter amendments and revisions to the Municipal Code relating
to personnel services, staff reviewed the Personnel Rules and found them to be outdated
and not in conformance with current personnel practices as well as state and federal
requirements. A request for proposals to revise and update the City's Personnel Rules,
adopted in 1983, were sent to three firms specializing in the field of human resources
with Richards, Watson & Gershon selected to complete the comprehensive review.
This firm has been assisting the City with the Personnel / Civil Service Municipal Code
revisions as well as the recent charter amendments relative to discipline and their
experience and knowledge specific to Seal Beach has been invaluable during the revision
process.
The Personnel Rules are adopted in fulfillment of the requirement of Section 905 of the
Charter. The purpose of the rules is to establish guidelines and procedures in all
personnel matters for all full -time classified positions.
The Rules were redrafted in a more modern format, adding additional information in
some areas where there were uncertainties and providing nrch more detailed procedures
and guidelines to the various topics addressed by the personnel system. The revised rules
also fully comply with the Charter; areas that had been omitted in the 1983 Personnel
Rules are now addressed appropriately. Significant changes include including recent
changes in federal and state law relative to the various leaves available to employees;
such as Family and Medical Leave, pregnancy related leaves, as well as
educational/daycare leave. Additionally, maintenance and care of personnel records are
addressed.
Orange County Employees Association have reviewed and accepted the rules as
proposed. The non - represented employees have also been provided a copy of the Rules
and an opportunity to comment.

There are two bargaining units that have yet to review the rules, the Police Officers
Association and the Police Management Association — both of whom are under a three -
year contract. The Rules will be presented to those units once contract negotiations
begin and the 1983 Personnel Rules will continue to apply to those units until that time.
The Civil Service Board considered the revised Personnel Rules at their February
meeting, suggested minor changes that do not change the intent of the Rules and
unanimously recommended Council consider adoption of the revised Personnel Rules.
FISCAL IMPACT:
The $7500 cost for the comprehensive review was authorized by Council and budgeted
through the budget amendment process.
RECOMMENDATION:
With the adoption of Proposed Resolution # , Council will approve the revised
Personnel Rules attached as an exhibit to the Resolution.
