ROLL CALL Present: Mayor McKnew Councilmembers Barton, Blackman, Holden I Absent: Councilmember Sales It was noted for the record that Councilman Sales absence from the meeting was excused. Also present: Mr. Courtemarche, City Manager Mr. Coughlan, Assistant City Attorney Mr. Halldin, City Engineer Mr. Neprud, Planning Directo1-' Mr. Thomas, Finance Director Mr. Gaudio, Assistant to the City Manager Mr. Little, Assistant to the City Manager Mr. Wilkinson, Civil Engineer WAIVER OF FULL READING I , Blackman moved, second by HOlden, to waive the reading in full of all ordinances and resolutions, and that consent to the waiver of I reading shall be deemed to be given by all Council members after reading of the title unless specific request is made at that time for the reading of such ordinance or resolution. AYES: Barton, Blackman, Holden, McKnew NOES: None ABSENT: Sales Motion carried PROCLAMATION Mayor McKnew proclaimed the week of May 9 through May 15, 1976 as "Foster Parent Recognition Week." PUBLIC HEARING - LAND USE ELEMENT - GENERAL PLAN Mayor McKnew declared the public hearing open to consider amendments to the Land Use Element to the General Plan, The City Clerk ,'. I certified that notices ha~ bee~.p~li~h~d as required by law and that no communications haq been received either for ,.or 'against 'the matter. Mr. Neprud, Planning Director, presented the staff report and recollllllendations of the Planning Commission. The City Attorney reported that the Council had before them a revised resolution 4-12-76 -, , .- containing a statement regarding the negative declaration and giving direction to the City Clerk. Mayor McKnew invited members of the audience wishing to speak'to this matter to come to the microphone and state his name and address for the record. Ron I Kredell, 1615 Seal Way, read a letter regarding Redevelopment Agency actions and expenditures' and submitted same for the record. Martin Murphy, 1716 Bayou Way, spoke in opposition to moving the Police Facility. Jesse Rountree, 1527 Marine Avenue, spoke I' . I regarding constr:uctio~ 9f the Pol~ce Fac~lit~ in the area of an earthquake fault. Albert delGuerc~~, a Seal Beach resident, asked that no action be taken on, this matter at this time and requested a committee to study relocation of the Police Facility. George Supple, 1605 Merion Way, spoke regarding geological studies as it related to the relocation of the Police Facility. Gilbert Nelsen, 1001 Seal Way, spoke regarding costs for construction of .' ' I a new facility and favored mod~fi~~tion of the existing Police Facility. Mr. Halldin, City Engineer, was duly sworn by the . I Clerk and related i,nformatio~ :regarding the. current laws governing building near fault areas, information utilized in compiling the geologic report and stated that the geological report wa~ satisfactory for relocat~on ~~ the Police Facility . , and the City Yard ~n ~he proP9sed area. Ron Kredell asked the cost to revamp the.~resent ~~cility if it were. to be used by other agencies. Mayor McKnew responded that if the building were to ~e.used for municipal purposes other than a safety facility such as a Police Department, the estimated cost could be $200,000 to make the buildiI!-g stI'l,lctl:l8l1y safe. GUSTAFSON - 1976 EMPLOYEE OF THE YEAR Resolution Number 2540 was presented to Council and read in full entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, HONORING MERYL R. GUSTAFSON AS THE '1976' CITY EMPLOYEE OF THE YEAR." Holden moved, second by McKnew, to adopt Resolution Number 2540 as presented. AYES: Barton, Blackman, HOlden, McKnew NOES: None ABSENT: Sales Motion carried Mayor McKnew further commended Mr. Gustafson who was introduced , to the audience to a round of applause. RESOLUTION NUMBER 2541 - LOS ALAMlTOS NAVAL AIR STATION I Resolution Number 2541 was presented to Council by title "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH VEHEMENTLY OPPOSING ANY PLAN TO REMOVE THE NAVY FROM ADMINISTRATION OF THE LOS ALAMITOS NAVAL AIR STATION (LANAS) AND SUPPORTING THE CURRENT LEVEL OF OPERATIONS AT LANAS AS THE MAXIMUM, COMPATIBLE, SAFE USE OF LOS ALAMITOS NAVAL AIR STATION." By unanimous consent, full reading of Resolution Number 2541 was waived. McKnew moved, second by Blackman, to adopt, Resolution Number 2541 as presented. A. Approved the minutes of the March 22, 1976 regular meeting. B. Approved regular demands numbered 18073 through 18477 in the amount of $262,439.91 and payroll demands numbered 12941 through 13190 in the amount of $104,113.91 as approved by the Finance Committee and that warrants be drawn on the I Treasury for the same. Received and filed the Animal Control Activity Report from March l.through March 31, 1976. G. Approved the plans and specifications for Pacific Coast Highway storm drain and directed the City Clerk to submit two certified copies of approval to the Orange County Environmental Management Agency prior to the bid date of April 26, 1976. H. Approved request to hold over the matter of the report to City Council regarding purchase. of police vehicles for thirty days in order to complete investigation. 1. Ratified Claims Review Committee recommendation regarding claim of Burtis E. and Marie Doolittle I Davis for property damage and authorized payment with appropriate release by the claimant._ AYES: Barton, Blackman, HOlden, McKnew NOES: None ABSENT: Sales Motion carried REPORT - HEATHER PARK TENNIS COURT LIGHTING A report from the City Engineer making 'recommendations regarding Heather Park tennis court lighting bids was received by Council. Mr. John Ballard, 4589 Elder Avenue, stated that he was a contractor and posed some questions and made recommenda!;ic;m~_. regarding this particular project. Blackman moved, 'second by Holden, to direct the City Manager to place a stop on ,the purchase order for the design and manufacture of the controller for the project. Mayor McKnew recommended that Mr. Ballard and Mr. Orr meet with the City Engineer to review , 4-12-76' I .' the project and discuss alternatives and that a final'recommendation be presented-to Council at next meeting: , ' . AYES: Barton, Blackman, HOlden, McKnew NOES: None I ABSENT: Sales Motion carried REPORT - CONTRACT AMENDMENT - SEAL BEACH SPORTFISHING . Denis Thomas"Finance Director, reported'that as a result. of a recent audit there appeared. to be a clerical error which disclosed an underpayment 'from Mr. Hale and also an. over payment based on galley sales which is not clearly defined in the contract and recommended resolution as outlined in his memorandum dated April 5, 1976. Discussion followed. Blackman moved, second by HOlden, to refer this matter to. the City Attorney for legal review.. AYES: Barton, Blackman, Holden, McKnew NOES: None ABSENT: Sales Motion carried I COUNCIL REPORTS and REQUESTS Mayor McKnew stated that he had resigned from ~he Criminal Justice Council and suggested that careful consideration be given for this City ot have representation on County level committees such as the Criminal Justice Council, Flood Control and Youth Authority. Mrs. Barton asked the progress of the traffic signal installation at Pacific Coast Highway and Anderson Street. ORAL COMMUNICATIONS Mayor McKnew declared oral communications open from the audience. Albert DelGuercio, 4417 Birchwood Avenue, requested that the City Manager'be directed to investigate the possibility of a conflict of interest on the parts of Councilman HOlden, Councilman Sales, I Councilman Blackman and Mayor McKnew for retaining Glenn Watson as City Attorney and also retaining his firm ~of'per~onal matters. Mr. Del Guercio related that he had received an opinion from the Attorney General advising him that there was no conflict on the part of the City Attorney Glenn Watson in serving as counsel to the Ci ty and as counsel to the Councilmembers. Mr. DelGuercio also 4-12-76 If' asked for a comparison of City Attorney compensation.' Discussion followed. Mayor McKnew indicated that'he had no objection to such an investigation at the County level. Holden moved, second by Blackman, that the City' Manager be ' , authorized to send a letter to the District Attorney, with a copy to the Grano'Jury, indicating that this Council has no' I objection to any investigation by the County staff at their convenience and would personally meet with them at a mutually agreeable time and, that the letter should, clearly indicate the, name of the. person initiating this investigation. AYES: Barton, Blackman, Holden, McKnew NOES: None ABSENT : Sales Motion carried Martin Murphy, 1716 Bayou Way, thanked the Mayor and the' Council members for their,support in keeping Main Street out of the Redevelopment Agency. George Supple, 1605 Marion Way, spoke regarding, the Naval Air Station and cautioned the Council that it is necessary to maintain our vigilance in this area. There I were no other oral communications; Mayor McKnew declared oral communications closed.
